I know i should take legal advice but i dont have the £7-£10k the solicitor wants to take this on so ….

I have a financial order from a court that the person named is refusing to comply with (its a divorce settlement). It clearly says on the court document that failure to comply is contempt of court.

I have told the court about the non compliance and contempt of court but they have told me very bluntly that the only way i can do anything about it is to pay a solicitor .

Has anyone had to do this or know how to do this withoutca solicitor ? i assumed the court would be interested in contempt of court (they clearly arent) and maybe there was a form to fill in and a small fee to get this back in court but apparently not.

ETA i think google has been my friend , i found a form N600 that i can fill out and send to court. Its a shame that courts are designed to be baffling, inaccessible and obstructive for those who cant pay a solicitor !

I had something similar with my ex-Wife with the financial settlement / child arrangement orders etc. She blatantly ignored them and just 'did her own thing' regardless. Arrogance personified.

My Solicitors advice was that I would love to take your money but as she said, you're wasting your time so do not even bother as District Judges are simply not bothered in the extreme.

Can you recall when an ex-Wife or Mother has ever been sent to HMP for breaching a court order? No, me neither...
My solicitor told me he’s happy to take this on for £££ but its likely the result would be no action from the court.

Looks like its only £275 to submit the form i think i will do that just to see what happens . At the very least it might make her do something if the court writes to her even if its just letting her know i have submitted the form.

Looks like im stumped , even the N600 form cant be submitted without paying a solicitor and im sure mine will want at least £1000 just to fill in the form .

It pains me that our legal system is only accessible if you have a solicitor and £££.

With a fair amount of googling on this subject it looks like contempt of court is mostly ignored anyway.

An affidavit is required to go with the form and thats going to need a solicitor and from previous experience with my divorce i know that they will rinse me for it.

Its a moot point anyway , looking at other peoples experiences from a lot of googling it wont change anything , it was just an idea i had about how i could enforce the order.

Back to the drawing board to find a workable solution .
