Hello all,
I did a naughty speed nearly 5 years ago and had to go to magistrates court for a short ban. Totally my fault and I've been driving like an angel since.
I'm looking at insurance - it's getting to the point where the offence in May 2019 is past 5 years, but the conviction is not (can't remember if it was the following October or march). Do I have to declare it to the insurance company? I don't know if they go from the court date or the offence date.

If you can't see a definitive answer in the T&C's, then ask your ins co

Everything in terms of court convictions for the purposes of points dropping off or totting is taken from the date of offence, so you would like to think the ins co's would also work by the same criteria for declaring

In case anyone comes across this in the future, MCN compare specifically ask for date of CONVICTION so I put it on there. Out of interest I had a look at if it was without and the difference was about 25 quid (368 vs 340 with the same insurer). Obviously I'll be getting the insurance with the full truth!

Sounds a bit cheeky really. You're now paying extra for an offence committed over five years ago which, unless I'm mistaken, they are not meant to ask about.

My policy documents reads as follows:

Motoring convictions and/or fixed penalty endorsements in the last 5 years
• We’ve used DVLA records – for details visit: gov.uk/view-driving-licence
• There’s no need to call us if anything changes, we’ll check this for you at your next renewal
Claims in the last 5 years
• None
……
So they will check via DVLA anyway.

Date of offence matters for points (or totting bans), but date of conviction matters for insurance. Sounds like being stiffed both ends.

I would certainly not be taking that as gospel. Ins co's have plenty of form for spouting absolute garbage on their websites when it comes to legalities. They are asking about an offence which happened more than 5 years ago which is wrong, the date of conviction could be a considerable time later, in some cases years

Perhaps the OP should be talking to the ABI to get an answer that is more likely to be correct, would be interesting to see their answer
