Bus lane but no road markings

Hi everyone,
I was in Birmingham earlier this week for the first time. There was a stretch of 2-lane road that was being resurfaced and was only loose gravel.
At one point I see a sign “bus lane” and decide to then move to the right lane but suspect that this had started earlier.
If there is no road marking at all, am I likely to get a PCN in the collective’s opinion, and if so am I able to fight it (any picture taken would evidence the absence of markings on the road).

Markings are only used in support of the upright signs - it is the upright signs that are the legal instrument. The road markings do not have to be there for an offence to occur, but it may be seen as "unreasonable" to prosecute if they are absent and the road layout is not 100 percent clear. All depends how reasonable the local enforcement team are.

Although the signs are there; in this case there doesn't appear to be an actual Bus "Lane".Birmingham publishes the list of bus lanes with camera, just see if you were on any of them.

I think you may mean All Saints Way West Bromwich. (can't find one in Birmingham) As far as I'm aware i've nevr seen a bus lane there - Possibly Walsall Road ? I believe it was All Saints Way but don’t know for sure.
In any event, it has been over 2 weeks so it looks like there was no camera / I was shown some leniency.
