Defend the claim on the basis that the claimant has failed to provide any evidence that the defendant was the driver of the vehicle at the time.

I think the Protection of Freedoms Act allows the parking company to go after the registered keeper.

Yes they can, if they follow the correct process. Which they apparently didn't in this instance.
