Highly likely, and I believe it is up to the Clerk of Court to follow this up now but my experience of them is they will do naff all about it.

Yup this has probably happened.

Glad you had some progress. Once you have written confirmation from the court that it is not you, then drive.
And please go to the national media.

No-one will remember you as a drink driver. It can only highlight the failings of the court , or , more likely, the DVLA , as it seems that the DVLA didn't verify the driver number.

Other options include BBC Watchdog and making a social media campaign. But national press would be the easiest and you may even get a few quid.

Saying nothing will not resolve the issue nor stop it happening to anyone else in the future. It's peoples lives they are messing with.

Is it possible that the person that was banned never had any form of licence, so that when the DVLC have received info from the court the only person on their system with that name and date of birth is the OP?


(Although it was mentioned that the court had the correct driving licence number for the convicted person, but who knows!)

Just had a call from the DVLA saying that the ban has been removed from my record.. Interestingly they are still blaming the court for sending them over incorrect information whilst the man at the court said that it was the DVLA that had done something wrong.

Ask for it in writing, fax, email, etc...

Pretty quick work to be fair to them.

Good for you. Personally I wouldn't do all the social media stuff and newspapers but I would write (on paper) to your MP, copy the Secretary of State for Transport, a formally worded complaint and precis of what happened. These sort of mix ups are not good enough and has been said the other guy is probably driving round with a licence.

Really? What is your experience of dealing with the Scottish courts?

Me too. Surely they don't rely on just name and DOB, as the OP says he was told?

What did DVLA do - just pick one at random?

A while since I did it, but the form sent by the court to DVLA (a D20)contained (amongst other things) the drivers name, date of birth, the offence and sentence, and crucially the drivers address.

Unless the court magically knew the OP's address, my money is on a DVLA fkup.

if your the sort of person who is capable of getting a 4 year ban, would you actually care if you had a licence or not?

Scary that this could happen so easily. I thought DVLA recorded offences on ghost licences where the offender didn't have one? Not just look up someone with the same name & DOB in their system and go "he'll do"...

I agree with that - my missus used to work for a Government department and when a complaint comes in from an MP it goes right in at the top and gets a lot of attention.
