In the BBC news recently it was reported that Cumbria (for one) has manned all it's talivans with civilian operators only. In my view this provides a cast iron defence because the opinion of speed must be made by a POLICE officer, then corroborated by the speed measurement device. Therefore if you could show there was no police present there should be no submissable evidence for the prosecution to present.

Has anybody heard of a case like this?

Yep - there's definitely a previous case from South Wales which was won on this defence.

It's in the 'Civilian Operators' thread of the 'Judicial Process' part of the forum on www.pepipoo.com.

The ABD were looking for someone around 6 months ago for a test case - never heard a thing since...

Done some checking and it appears that the talivan must be manned by at least one POLICE officer to be legal. The POLICE officer must be a current officer, retired is not good enough.

Anybody who has been convicted by civilian operators should appeal the verdict.
