Can ebay force a private seller to take a item back??? hoping someone can help??
I had a vehicle for sale guy contacts me says what engine it is in it and its code he asks me does it run ok I say yes
he then asks would I sell just the engine and box ,he offers the asking price says put it on a buy it now , pays for it I remove the engine he collects it .
a few days go by and yesterday get message the engine is no good , I write back saying whats wrong how far have you driven it and what is wrong because it ran really well I'm really surprised , he writes back his mecanic says its no good he isn't going to fit it and its still on a pallet !!!, I'm sure the engine is ok its no good to me as the vehicle was sold for scrap after i removed the engine.. any ideas on how to sort this out?? seems ebay see private sellers the same as business sellers !! they said I should take it back and re sell !!
Thanks ....

Being a private seller makes no difference, you still agree to abide by eBay's terms and conditions. If the sale was covered by their buyer protection program and they paid through PayPal then you pretty much have to take it back and refund the buyer or eBay will most likely just give them the money back anyway.

You need to look at the details of the sale and the applicable terms and conditions to determine what's going to happen, but that's the most likely outcome.

Whether you get the actual engine you sold back is another question. Do you have evidence of the engine number etc?

What was the listing for? A car or an engine? If it was for the car, the eBay's money back guarantee does not cover cars.

ebay says said:
There are certain items that the policy does not include such as services; intangible goods, and items listed in categories such as Vehicles (including, motor vehicles, motorcycles, caravans, aircraft and boats); Gift Certificates; and Residential Property (Real Estate). See the eBay Money Back Guarantee policy for full details.

The origional listing was for a complete 7.5 ton iveco , the buyer asked me to change the listing to an engine and gear box !!! so maybe he was planning some fraud from the start , he says the engine is still on the pallet so how can he say its no good ??

Ive still got the V5 hopefully thats enough proof , and yes what you say is about what the guy on the ebay help line has said he did say to attempt to resolve it by offering something towards parts to fix it but as he won't fit and try the engine it
looks like a dead end ...

You will probably get back the knackered engine from his truck, having been replaced by your good engine.

Remove the cards of your PayPal account and close it down before they rob your money back

OP

I think you will be on the hook for the item being returned, he will inform ebay/paypal it is not as described and they will force the return and return the money. Look up the Ebay Guarantee it's something they advertise. You might even be on the hook for the return postage!

It is possible you will get the a different engine in return but unlikely, its far more likely that it's a case of buyers remorse or he has found a way to fix the engine he had. Time will tell I think.

Can you not resell the engine on the pallet as you know there is nothing wrong with it?

Tell the seller you will take it back and refund him provided the marks you put on the engine specifically on the removable parts to prove its the same one being returned match up.

If the don't match then you will not take it back and charge him for both the inconvenience and time taken checking over the engine.

Why do people still use eBay and PayPal? Never read anything good about either institution.

In my experience you are very wrong.

I'm with the other guy above - he's swapped over the engine or whatever part was broken on his and you'll be getting his knackered one back. Otherwise how can his mechanic say it's no good if it hasn't even been used? If it looks like bullst and smells like bullst then it's bullst. You're about to have your pants taken down and given a good shafting.

done that and I paid a bill with most of the paypal balance , will wait and see but , seriouly if he had fitted the engine and had an issue then thats fine I would have been surprised as it started and ran really nicely but given the benefit of the doubt , but I've gone to some trouble taking engine out of the truck and scrapping what was left to keep the peace with my folks I've no truck and if its sent back an engine thats maybe had bits swapped or a different one to re sell , I did my best to help the buyer and he is kicking me in the guts .. I haven't agreed to the return so if ebay want to force it I will make it as difficult as I can and will wait for litigation before I go any further...
