I recieved a letter this morning from the police giving notice of intended prosecution, for driving
1:dangerously
2:without due care and attention
3:without reasonable consideration for other persons using the road.

Last Sunday afternoon I turned into a road and noticed in front on the left a parked coach, and a old lady staring to cross the road behind it, as I was only doing about 15-20mph I did'nt brake as she had plenty of time to cross, as I approched her she shouted to me that I should have blown my horn to warn her, I said b*****ks and carried on, I went round the corner to a shop , came out 15 mins later an there she was writing down my reg number, she said she was going to report me to the police, I said yer yer and that at her age she should know the green cross code.
Anyway I was woundering what the police will do if anything as I don't see that I have done anything wrong. I have been back to the area and there is no cctv cameras to co-oberate my story.

to me it doesnt sound more than a warning follow up after a complaint, but perhaps a member from BIB might be more help, good luck in any case

Were you driving the Cerb? How would she have heard the horn over the exhaust?!?!

Police duty bound to serve NOIP for those offences in order, if on following up the complaint, they amass sufficient evidence to support a prosecution.

I would anticipate a visit from BiB to get your side of the story.

Witnesses on the coach?

I had a DD NIP, and they were serious about sticking it to me. However I refused to provide details, because they would not tell me what I was supposed to have done. They also made some errors, which I nailed them to the wall for.

This is scary I admit - an accusation that you cannot defend against. It is a shame that other people have such a power to give you $hit. Best of luck, but you're well to do in denying being there.

Cripes. Im now thinking back to earlier today when I was driving through a town centre and a woman was on the pedestrian crossing ahead of me.

I stopped in plenty of time / space, but the daft woman was going absolutely nuts as if id run her over! and she was staring at me / the car even after shed finished crossing and I was moving off.....

Must have been a noisey = fast numptie.

I was in the cerb I think the noise may have made her jump a bit because she was behind a coach.

Blowing the horn would have been a good idea then.

Daft old bat. Hopefully Plod will see that. They would still have to follow procedure to keep her from complaining about them!

I feel for you, however make sure you reword your observations as pedestrians have right of way as per the highway code which states:


watch out for pedestrians crossing a road into which you are turning. If they have started to cross they have priority, so give way.

I'm trying to get the picture here. Was the lady between you and the coach or was the coach between you and the lady? Was she crossing at the corner or some distance away from it?

If she was the far side of the coach, then she has no particular right of way (and would have been blind to oncoming traffic); HC7 - Green Cross Code - and HC14 would apply ... not that pedestrians ever read the HC, and most motorists ignore it when they are on foot! If she was crossing at the junction, then you should have given way to her (HC146).

As you were in the Cerb, I suspect the exhaust roar suggested to her that you were travelling at high speed. Any passengers on the coach might have had the same impression. I assume you changed down approaching the corner, with the concomitant increase in engine noise. It's a 'cross' we have to bear (), but it shouldn't be used by the ignorant to crucify us .

PS - was it not previously the case that pedestrians only had priority over vehicles turning left into the road they were crossing? - S

There were no passangers on the coach and it was between me and the lady, but there was so much room between me and the lady, I could have speeded up and she would have still got to the other side of the road before I reached the point where she was crossing.

visit form BiB - give story in a reasonable manner and stress the control you maintained - distance and awareness - NFA

That is what I am hoping.
My car got keyed last week and all the help I got from the police was "Sorry sir there is nothing we can do", which is what I expected.

Bit different?

Dont start being negative om the cops - If youd have seen the offender the police would have reacted differently
DOnt turn this into just one more "bash the cops" session

In your old lady case - the "offender" was seen and recognised - she alledges!
Just have to show she was over reacting - had it been different and you were crossing the road when someone transgressed - youd want action?


What Im saying is let the law prove your innocence!

No?

Well how do you expect the police to do anything about it? What are they meant to do... get their crystal ball out to find out who it was?


I would expect the local BiB to have had dozens of similar incidents reported and have a fair idea of which member of the local scum was responsible, go round there and take enough possesions of theirs to pay for the damage, and yes I suspect they will have possessions, even if its some horrible arse turbo.

If I have missed something then apologies, but what -exactly - does the letter ask of you? Is it an official NOIP or is it a normal letter?

Requests for information have to be made by or on behalf of the Chief Constable of police. If there is no such request on your letter, then there is no requirement to furnish any information.

Ummm, shouldn't the Law have to prove his guilt? I thought he was innocent until proven otherwise?

I checked with the neighbours and mine was the only car damaged along the street, I live just off a busy main road with loads of people walking past, so it could have been local scum or someone else.
I have lived here for over 4 years and never had any problems before, nore has the neighbours. So I am hoping it is a one off.
