I had an accident in a company car and I got a producer.

Now I didnt have insurance docs on me, so the company HO is in Scotland. They faxed a copy down to my office, which I knew the Police would not accept.

However they said they would.

Went to nick and they said no.

Now I understand that they then produced it in Soctland (BellsHill) but they could not confirm the that a log was made of it.

Now, I still to to roduce my drivers licence.

I dont work for the company now (long story) think they are trying to be funny.

Can I be prosecuted for failing to produce, when the company wont send me the certificate or confirm its been produced.

Anything I can do ?

cheers

Having been given a "producer" it is down to you to produce within 7 days personally your Driving Licence at the elected police Station. In relation to Insurance Certificate this can be produced by someone else within the time limit but if not then it is you that has failed to produce.

There should be no problem in relation to the DL but if so and this also applies in relation to Insurance if reported for fail to produce then it is a defence
to show that:

a) Documents produced within 7 days at the police station elected,or

b) Were produced at Police Station as soon as was reasonably practicable.or

c) It was not reasonable practicable to produce them before the day on which proceedings (the date the information was laid)were commenced.

Never under estimate the compassion of Bib. Go to the Station you elected production and point out your difficulties. You have the fax of the Insurance details from which BiB can confirm either by Police Records or direct contact to the Insurance Co whether or not you were covered. Checking DL is easy peasy.
