Parking Ticket! But Bike Bay Had A Skip In It...!!
Discussion
I am pissed off!
I was in Hampstead today, on Frognal road.
There is a motorbike bay over there. Its almost opposite the place I needed to pop into.
However, the bike bay had a BIG yellow skip in it that took over (takes over, the f***ing thing is still there) 70% of the bike bay. There were 3 other scooters parked alongside it and absolutely no room. I couldn't park my bike there obviously and though I looked around I couldn't find any other bays.
I had to stop there, so I parked in between a couple of parked cars (I did not take a residents space in the least). When I came back (made it very quick) I had a ticket!!!
I can't believe it.
I want to contest this. I was FORCED TO use the darned residents space and did my best to avoid taking a whole space.
Any advice?
Any policemen, legal advisers who could tell me what to do and whether I have a case? I could easly take a picture of the skip as evidence.

Not very bright my friend.
What do you think the answer to that is? Of course I wouldn't.
The fact is the bay was NOT full of bikes. It was had a skip in it. If the powers that be can't be bothered to move something that is clearly taking up limited park space, then surely it is wrong to then penalise someone for not being able to use that same space.
The bike had a skip in it. Thats that.
A bike parking bay needs to have bikes in it. I didn't see a 50 pounds fine on the skip.
I look forward to hearing the next pearl of wisdom.

You were not FORCED to park where you did.
You were prevented from parking in the Motorcycle bay, which is quite a different issue.
If the skip had been parked in resident's car space, could a car have then parked in the motorcycle bay? I think not.

Where would you like the skip to go??
Obviously the skip was serving a purpose, a receptical for builders rubble most likely, so wasn't there on an afternoon jolly.
If it was a car taking up space i can see your point.
Sorry to say this but you goofed. I've had a few good runs ins with parking crap and usually drawn or once lost on occasions. Forget the skip issue, it's irrelevent. You parked where you shouldn't have parked in the eyes of the local authority. So they gave you a ticket. Feckers they are, I have no doubt of that but you may as well pay or emigrate.
Was the ticket machine jammed?
Boosted.

I cannot believe I am doing this but here goes.

Whilst I can concur with what already said.....
Check with your local Council to see if they had given permisssion for the Skip to be on the road. If not then it is illegally placed.
By being illegally placed it occupied parking space that should have been available. This fact might, and I only say might, give you grounds to go for an appeal but if you do then make sure that you take past Stage 1 to the LA and to Stage 2 the Adjudicator where you may get sympathy on the illegaility...

You will need evidence though, so get out your (non digital) camera and get back there before the skip vanishes!
Of course your evidence will probably not count as the photo would be taken on a different day
or some such other crap.
I agree with you that should not have to pay this, but agree with the others in that you probably WILL end up paying....

I agree with some of the earlier posters - you parked illegally and are almost certain to have to pay for it. I cant see how the skip being there has any relevance to your illegal parking. The authority is not obliged by law to provide those spaces, and may grant permission for them to be out of use for whatever reason. Of course the skip may have been there illegally, and then they should be fined, but it does not absolve you of your duty to park illegally. It is like saying `this guy was in a designated space without a ticket (illegal) so I therefore went and parked on the double yellows as that space was not available to me`
I can see why you are pissed off, but if you are honest with yourself you will admit you took a chance that didnt pay off....

They are simply after your money, in order to pay over-inflated runaway pensions and rampant cash wastage.
Thanks all for the slaps on the wrist and for the (occasional!) vote of sympathy.
I'd like to make it clear that I looked around, and there was nowhere else to park. Hence, I parked in BETWEEN two cars that were already there. If one or both had moved away, two cars (as the space provides for) could have parked in there again. I intended to be out asap.
(1) I know I parked illegally
(2) I shouldn't have
Conceded. Happily conceded.
(3) What I am saying is this: The skip is taking up space which is precious. There were no other bays, and I looked.
(4) Just a pity, I could have used the space if the skip had not been there.
(5) Intersted to know if the powers that be would take the trouble to ensure the skip is moved, or if it had permission to be there.
Anyway, that's all I have to say on the matter.
Touchwood, £50 is hardly going to bankrupt me. Its just the principle (and no, not the "legal principles" before a few of you get excited again.) of it.
Equitably yours,
