Not sure if this should go here or 'Speed plod and the law' so move if necessary.


I had an accident on the motorway yesterday. Cars were moving at a steady speed because it was a speed monitoring area so traffic had slowed to the 50mph limit. Somehow a cone appeared in the middle of my lane so I braked to a stop since I couldnt swerve into the lane to the left. The guy behind me braked to a stop but the guy behind him, hit him at such a speed that it pushed the car in the middle into the back of my car. The policeman says fault wise, I need to claim of the guy behind me, and the guy in the middle needs to claim of the guy at the back.

Firstly who do I contact first. I was driving my dads car, but my own policy covers me for third party cover on other cars. Does my dad need to contact his insurance company too, or will my original insurance company sort it out.

OR Would anyone recommend use of companies that claim 'no win, no fee' etc or even companies that help you get a hire car (Accident exchange.)

The guy behind me was Polish and he says his insurance company is in Poland. Will I have any trouble claiming off them.

Overall, under which circumstance will I get the best price for my dads car.

Oh dear. With third party only (driving other cars) cover you are on your own to a great extent. I'd would suggest you do contact one of the claims management companies (try Anniesdad on here).

The police are right, you claim against the guy behind you and his insurers then claim from the guy at the back - they will spend months arguing about who hit whom first and you may have to wait until that is resolved.

What type of value is your Dad's car?

edited to add...just to clarify having re-read your post, neither your dad's or your insurers will get involved to fix/replace your dad's car, you have third party only cover from your insurers so they won't have involvement in your damage and presumably you are not insured under your dad's policy?

If you have the insurance details for the other two drivers, and no blames directed towards you i think the best course of action is to call your insurance and give them the other drivers details, then get your dad to do the same with his insurance company.

The cars an early E46 BMW 3 series so not huge value. I had always driven his car under the presumption that if I had an accident and it was my fault, then I would be fully liable for any damage to my own car, but my main insurance policy on my own car, would cover any damage to a third partys car. Under the current cirucmstance, I dont think I'm at blame so would they not even help me claim against the other party.

I'm with Bell.co.uk and there was an option box where it costs £20 odd pound extra for third party cover. This is what it says;

"Drive other car

This provides cover for the policyholder to drive any other privately insured car, on a third party only basis, as long as the car is being driven with the owner’s consent and within Great Britain, Northern Ireland, the Isle of Man or the Channel Islands."

Shouldn't be a problem since they are in the EU and are regulated as such. Did you take any photos with your mobile phone at leats?

The first part of this post is the correct advice: Contact an Accident Management Company and supply all details to them. In these circumstances they will probably pursue recovery of your losses directly against the insurer of driver three. Driver two was not negligent.

You do not need to claim off the Polish chap - you claim directly from the person who caused the accident. Presumably you only felt one impact?

Your/your fathers insurance company will not be interested in helping you with the claim as essentially there was TPO cover in force at the time.

Completely off the point here, but there's no way I would have braked to a stop for a trafic cone, the cone would have gotten collected pure and simple.

Very lucky that no one was seriously injured.

It is correct, actually. The negligence of driver three caused the impact between driver two and driver one.
However, the OP does not need to be concerned with this. Its besides the point. He should use an Accident Management Company, and they will do the job, not him.

Well, if you all insist, but that's not the way my insurance company handled it when I was at the front of a 3-car shunt a few years ago.....
We do insist. Because some of do this sort of thing for a living. Yes, you might approach the insurer of driver two. And they might reimburse you and then recover from driver three. But, its simpler to go straight to the cause.

Agreed - give Steve a call as he's the expert on all this. His company is www.europaconsultants.co.uk and you'll find his direct number on the contacts page. He's helped out a number of PHers, including myself with a very complex foreign claim against the AAs Euro recovery agents. Something my insurance company didn't want to even know about.

I had a similar situation about 6 years ago, though things may have changed since

i was stationary in a queue of cars for a traffic island - the car behind me (corsa) stopped, the car behind her (golf) hit the corsa and pushed her into me (quite gently i will add) then a car (accord) hit the Golf and pushed the corsa into me again - this impact was much higher.

The Golf it would appear was uninsured and gave a false name, but correct address to the police.

I put it to the insurance company in about the same way as i write above - they claimed off the accord and i got my excess back.

Dont see any reason why an accident management company cant do the same.

The accord driver spoke little english - i never found out if his insurance was through a uk insurer or not.

Policemen are many things, but they are certainly no great shakes on insurance issues. They need sellotape over their mouths sometimes smile

Got photos on a camera but not directly of three cars in a row, because I indicated to move to the hardshoulder. Just of the damage.

In hindsight, I thought should I have probably done that but instinct was to try and swerve to the left, which I then realised I couldnt so I just braked to a stop. Traffic was flowing slowly compared to average motorway speeds because of the speed monitoring thing and the cars upahead had slowed the traffic down further still.

We don't know how the cone ended up there (i.e. did it get blown across just before the OP arrived etc..) but nonetheless, I wouldn't particularly want to drive into a traffic cone if it was one of those giant bigfoot cones you see on the motorway. Having once seen a fiesta ahead of me drive into one, and their bumper flying across the carriageway, I think the OP probably made a difficult but wise choice. I wouldn't underestimate the damage that could be caused by hitting an object like that at 50mph.

At the end of the day, the ensuing collision from vehicles behind was not the OPs fault.

If you can't stop in the distance you can see to be clear...
