They shouldn't get taken into consideration by anyone after 3 years, but you can't have them removed until 4 years have passed I thinkthanks

Simon is pointing out that they are 9 years old if you got them in 2000!!!!!!!
As has been stated they are not officially on your licence after three years but you cannot apply for them to be removed for another year.
If you have an old paper licence then they will remain on the licence forever in hard copy format until you apply for a new one, but they won't be valid. Don't know what happens with the new style licence, i'm an old bugger now.
You won't get banned as you will only have 3 points coming your way.

- Convictions over 3 years old cannot be used for totting up. If you get 3 SP30s, at 3 points each, in the space of 2 years and you have one from over 3 years you will be okay.
- After 4 years you can have them removed; to do this you just apply for a replacement licence.
- You must declare any convictions within 5 years to your insurance company (in most cases) regardless of whether they are still showing on your licence.

The answer to your original question (as is provided in the linked thread), is that points are ALWAYS valid for totting purposes for a period of three years from the date of the offence - irrespective of the nature of the offence, the number of points imposed, or whether the points resulted from a fixed penalty or a court appearance.The duration of an endorsement upon a driver's licence and whether that duration commences from offence date or conviction date depends upon the nature of the offence.

Kinell, whether it's 3 or 4 years doesn't matter as both 2000 and 2003 are more than even four years ago!
Does anyone know why points cannot be removed at 3 years, considering they do not count toward toting up at that stage, seems odd. Mind you insurance companies take into account 5 year old points but thats just an extracting more money thing.
I remember being annoyed that a set of points I got, in very dubious circumstances were still on my licence after three years, however still on after much more than the four years. Just don't care now as points do not mean the same any more in the UK. They have lost the stigma because so many are given out.

Historically (and AIUI), it was to ensure that all points which required to be taken into consideration when a sentence was being imposed were clearly apparent to the court - which they may not have been if the rules permitted an earlier removal of penalty points.Gassing Station | Speed, Plod & the Law | Top of Page | What's New | My Stuff
