Hit by car, plod don't care, what can I do?
Discussion
Here is the situation, some old cow decided I didn't get off the road quickly enough for her liking (whilst pushing a pram!) and hit me with her rear view mirror causing a large bruise on my back.
She stopped at the end of the road then got back into the car and drove off when I went running after her to get her details.
Police have spoken to her and apparently I "scratched" her car so they are doing nothing further. How do I take this further? Is it possible? Are we really in a position now where if someone is struck by a car but the driver says they scratched the car nothing is done?

Do you have any witnesses?
Otherwise it's your word against hers. From a criminal point of view little can be done.
But she has admitted hitting him (the scratch).Otherwise it's your word against hers. From a criminal point of view little can be done.
I would escalate a complaint in the police. Failure to stop at least (though I forget the nuances of that)?
This is weird this one. What is the OP trying to claim for? A bruise? It wasn't done on purpose so it's not assault, she damaged her car on what? His shirt? Yea right!!!
As annoyed as the op may be, his bruise will go, and yes she should have stopped and apologised, he was crossing the road and he's allowed to do this, she could have avoided hitting him, could have been more observant, if understand why the OP is upset as he's the injured party but he's gonna have to let this one go. Sorry to sound negative, but I think this is one for everyone to just move on from.

Maybe he is trying to claim for... nothing. I would feel like I would want justice if someone hit me with their car whilst crossing the road with a push chair and showed no remorse. Being obtuse would probably make me want to see her banned. As annoyed as the op may be, his bruise will go, and yes she should have stopped and apologised, he was crossing the road and he's allowed to do this, she could have avoided hitting him, could have been more observant, if understand why the OP is upset as he's the injured party but he's gonna have to let this one go. I was not crossing the road. It is a single lane road and I was walking dogs and a baby down it. The car in question came roaring up behind us, and whilst we are trying to get off the road with the dogs/pram, she tooted twice then drove at us, hitting me whilst going past. That is what I am most upset about, she is a f***ng lunatic who needs stopping, another couple of inches and I (or my baby or dog or all of us) would have been flying over the bonnet of her car.

Did she remove her mirror from the car to hit you with it, or did you do so whilst going through the windscreen?Jasandjules said:

I suggest calling your local station and escalating your complaint. That is what I am most upset about, she is a f***ng lunatic who needs stopping, another couple of inches and I (or my baby or dog or all of us) would have been flying over the bonnet of her car.

I totally agree that she's a lunatic that needs stopping, but what you can actually do I doubt much. The main thing is you are ok and your injury will heal.
If she's admitted to hitting him, which it seems that she has, then she should be charged with carless/dangerous driving, or driving without due care, or whatever suits best. Might make her less likely to do it again, and will make it more likely that she is disqualified if she does.vonhosen said:
Or alleged criminal damage?
Correct that would appear to be the question. Yet the police have not asked me about that?Rear view mirror - wing mirror of course, perhaps I should have been more specific.
And I have a photo of the bruise! Showed plod when he was here talking to me about it.
I will ask them who I escalate it up to, as others have said, my main concern is this woman will really hurt someone one of these days - I should also have said, the week before she did similar but just missed me as I managed to move a bit faster!
Yes the police should have a word with her.You are supposed to stop and find out if the person is ok if you hit someone with your car.It is irrelevant if it is a car mirrow it can still kill the person.
I would pursue the matter next time someone else might not be lucky if she drives the way she does. What is the police for?

Its generally best to walk on the right side of a road so you can face oncoming traffic. That is what I am most upset about, she is a f***ng lunatic who needs stopping, another couple of inches and I (or my baby or dog or all of us) would have been flying over the bonnet of her car.
It amazes me how many walkers and joggers don't do this.
Not that it makes it right what the driver did, I would hassle the police a bit more.
