Hi, scenario as follows:

Big place booked for family Christmas
Sleeps 18, limited market, booked over a year ago for this coming Christmas
Smallish operator managing a dozen or so properties
T&C punitive eg no refund of £1000 deposit if we cancel, no refund for broken fixtures and fittings - just "fixed in reasonable time" which hadnt noticed before, imagine the cooker blows on Christmas Eve - whens a reasonable time to get that fixed??

Anyway phone call tonight to say its not available anymore
Been offered inadequate replacement which is really really not as nice
Chances of finding anything else from previous experience slim this close to festive period

Strangely no mention in their T&C's of them doing this

Are we shafted??

Reason: owner wants it, or has been offered more for it.

Solution: Take refunded deposit. Check out owners direct. Find replacement. More on with life, it's too short.

OP, you'll have a hard job enforcing use of the place over xmas but if you could prove that finding an equivalent place would cost more you've got the option of chasing for compensation for the difference.

Realistically though, you know that you'll find something else and that it isn't worth the trouble.

And avoid punitive T&C in future wink . If they're like this beforehand... and lo frown my cynicism came to pass abut such things in the original post frown .

I know its June however experience tells me that finding a place sleeping 18 over Christmas for a "reasonable" sum of cash isnt easy

I think you are being unreasonable.

"cooker fixed in a reasonable time" is all you would ever get in a contract. What do you want them to do, have a duplicate set of appliances available for every house with a team of fitters on 24hr standby?

Do you have your deposit back?

Deposit "in the post"

What would be appropriate though if you move in on Christmas Eve for 5 nights with a broken cooker having spent several grand on the rental?
Thankfully this is not an issue which need concern me

And something I would look out for next time

I may be unreasonable in this context however cannot imagine getting a cooker fixed on the 24/25/26th December therefore the whole rental becomes significantly unpalatable - a bit like a microwaved roast turkey

It's a risk one faces with life and not one that can be mitigated with a typical rental contract or agreement.

Don't worry too much about things that "might" happen in your life..you will drive yourself nuts...biggrin

My dishwasher "might" pack up next month.....If it does I'll deal with it then.
