Got a nasty letter from the DVLA this week telling me that I need to boost their income by £55 for failing to notify them that I had disposed of the vehicle I sold over four months ago! I sent the Registration Document part that I had to fill in at the time. The letter says that it is an offence that I have not followed the correct procedure.

Am I going to jail and for how long?

They are not fining you for failing to notify. It's for your failure to follow up within the required time frame to ask why they hadn't acknowledged that you were no longer the RK. In other words YOU doing THEIR job for them.
I bet you forgot to send it Special Delivery. You should ALWAYS send documents to DVLA by this method as they are tracked throughout (note that this is not the case with Recorded Delivery). That way you can prove they received them and notification was made.

The DVLA will use every means at their disposal to extract money from the motorist. Even to the extent of refusing to admit their ever make a mistake and getting the rules framed so that they always win. High time the Agency was reformed but it won't happen as the government is never going to willingly curb one of their prize cash cows.

Thanks Red. Did not send recorded or special delivery. Have bought and sold only a few cars over the years. Last one I bought (from a Dealer), I had to to fill out the bloody form to Tax it 6 months later as the DVLA did not know I was the new owner!

I think I might write a nasty letter to someone!

O/T but thought I'd share my favourite bit of DVLA stupidity.
Have a look at your logbook (V5C).
When you sell the vehicle you give the new owner/keeper section 10.
You then have to send the first page to the DVLA.
Simple?
Now look where the address is that you have to send the first page too.
Yes, on the bit that you just gave to the new owner/keeper biggrin

Or I can just give the DVLA a few more quid and when I need to find out where anyone with a car lives, I just need to tell them your Registration number!

I had the same in 2005, I still have the letter I wrote to them. They cancelled the fine.

Dvla tried that on me, told me i have got till the 21st of october to pay the fine. Now can any one guess when i actually sold the car?

Do you think DVLA sign for all the tracked items they receive? They're marked en bloc as being delivered ... whether they are or not - Streaky

Some say dont pay, I disputed the payment as they lost my paperwork in one of their offices. In the end they still fined me £40 which was half the original fine, after several letters. In the end I got fed up with their "we are right you are wrong pay us" attitude.

I now make sure I call them 1 week before the 4 week period is up.
HTF they manage to get away with fining people for their own incompetence is beyond me...

Do you have proof of that Streaky? If so, and they are not delivered, then Royal Mail have some questions to answer. They are taking under false pretences the additional monies paid by the sender.

Wasn't there another thread a month back which aid that if they can claim they haven't received the first class tear off slip, you can claim you havent received their first class bill for £55?

Someone please educate me for I must have missed it.

What is the legislation that permits DVLA to 'fine' for failing to notify which is an offence that Courts deal with.?

There is specific legislation to permit them to add a surcharge in relation to failure to SORN.

Poster please ask them for the Act and section that permits them to do this.

I have just sent my log book back to the DVLA as I sold my bike, in the instructions on the log book it says something along the lines of:

if you do not get a letter from the DVLA confirming that we have had the log book then please telephone this number and talk to us........

So if you sent it 3 months ago and hadnt had an acknowledgement you should have phoned.
