FINED FOR KEEPING CAR IN GARAGE

My sprite had a clutch problem and I put it in my garage to fix it.This was some months ago and now Ive recieved a fine through the post for not having insurance or declaring it sorn.The car still has valid tax but no longer insurance.Do I still have to pay the DVLA even though I was not notified of this new requirement,(I must add that at no time has the car been driven on the road without insurance,mot or tax,before being garaged it had Tax mot and insurance ).

Do you not get a warning letter before actually receiving a fine? Just curious, as I've not experienced the delights of these recent new arrangements....

Unfortunately, yet another example of the Big Brother society (I thought it was supposed to be Big Society, it obviously got lost in translation smile ) that we now live in.

When you do get it back on the road, and insured, just remember not to park 1/2" the wrong side of a parking bay white line, or that will be another £70; or move into a (camera 'controlled') bus lane to let a fire engine through, or another tax fine will be applied.

Or stay within the law and you will have no problems

The DVLA compare data bases from insurance companies, MOT and RFL to identify cars/people who have no insurance or no MOT and are potentially using the car on the road. Apparently some people use their car on the road when uninsured. The price we have to pay to enable this practice to be identified is to sorn if we are not using our car when it is not insured. Seems quite a bargain to minimise uninsured rogues on our roads.

If this is the DVLA's approach how on earth is there so many uninsured cars on the road?

Their plan has obviously worked here so surely this means there should be NO uninsured cars now.

Because they aren't taxed either.
Some aren't even registered in this country, others are, but not to the current keeper/user.
Also some cars are legally insured and txed but then used by people who are not insured.

would be intersting to know if its targeting those keeping their uninsured car in a shed, those using their uninsured car on the road, or those driving someone elses car without insurance

A somewhat small minded view given the petty things mentioned. It is possible for the law to be wrong, hence it's constant evolution.

Another useful dodge is to affix number plates from something else for a week or so - then ditch plates + swop these for another set & carry on.

All these laws/fines do is penalize honest people - the dodgers will ALWAYS find a way around

More like another sxample of people living with thier head in the sand, for gods sake the continuous insurance threadsare all over the web (this is what the 30th one one PH in the last 6 months?) flyers were sent out with tax reminders all last year (i had 9 cos i have a lot of cars) and i dont visit a forum that hasn't talked about it at length (30 pluss forums i use over the week).
sorry if that offens the OP but if you managed to miss the new regs you were really trying gard to miss them.

I remember a number of years ago popping out of the house to grab something from the car. A couple of coppers where "proceeding" down the road checking all the tax discs, one of them looked at the misses car then mine and called out to his colleague "You'll never believe this, two in a row with tax discs, don't see that very often", the two of them carried on there way. A moment later the bloke next door came out. "Wot they wont ay" so I told him it looked like they were checking tax discs.
That night most of the cars in the road changed, to be replaced by a new pile of heaps.

The only way they'll make inroads in the numbers of untaxed, uninsured un tested cars is to setup road blocks and just tow away all the offenders as soon as they find them. These days they'd probably have to switch off all the local mobile phone masts in the area they were operating too. Bet it would cause a bloody great riot though.

The point was that the law in the petty scenarios mentioned is unfair and has an unbalanced penalty system.

As always the people who register their car in their name at their address are easy meat.All those who drive around without tax,MOT,insurance,no fixed address,will never get done.

yes but as has already been put it wasn't a secret

OP if you feel bad see if you can appeal

ETA: it's a type of justice for not using such a great car more biggrin

Law maybe wrong but isn't to difficult to stay within it.

Agree. I also questioned if I would be fined as I cancelled my insurance when the car is in my garage (broken) and not yet SORN'd and got an array of abrupt and mis-leading responses (also incorrect). I left it about 2 weeks and most people told me I would of been fined. Still waiting on it.

As the sprite is my only car I will only need to do something about tax, mot and insurance anually,and as this new legislation is less than a year old? and they didnt send me the advisory letter how am I supposed to know.If you have 9 cars its much more likely you will get notified throughout the whole year.I believe they do need to send you the advisory letter before being able to take further action.

I'm sorry, but the rules apply to everyone. In addition, they have, as noted above, been well publicised and much discussed amongst car Spods such as us. Are you familiar with all of the provisions of Statute and Regulation across the board? Probably not, but they apply to you nonetheless. That's how every legal system works.
