Outside lane with inside lane empty, when is it acceptable?

i think the police train drivers to gauge lane hogging as any gap that pass for more than 10 seconds. i.e if you could have pulled in and travelled in the inside lane for 10 seconds or more, you should have.
on the way back up the M6 today i had a numpty in a 106 or something travel between 70 and 80 (constantly varied so he'd over take me then slow to 70 making me need to over take him as i had it on cruise at 73mph)
90 miles later and he was still in the middle lane. I think he didn't know the inside lane is for cars as well as empty space.
Doesn my nut in, turns a 3 or 4 lane road into a dual carridge way.

I would say as a general rule of thumb...
if your not holding anyone up its fine, if you are holding someone up, either indicate early so they are aware of your intention and can pass accordingly, or if theres enough room move out of their way then back into the right lane closer to the junction?
