The exact terms of the EXISTING contractual clause are important. He need not consider signing anything extra. Well, unless they want to pay him six months salary for example
IF they refuse to pay him wages/commission owed/due, he may consider that a fundamental breach of contract rendering the employment contract void. Thereafter they may have more difficulty enforcing a restraint of trade clause in a contract they have rendered void... Just an additional point.. More details would be needed for more accurate advice.
