If they're an Architect (the title is protected), then they shouldn't... and if you believe that you can substantiate that accusation, you should report them to the ARB.

Paragraph 1.4 of the ARB's code of conduct is "Where you make or receive any payment or other inducement for the introduction or referral of work, you should disclose the arrangement to the client or prospective client at the outset."

The retentions and payment stages will be defined in the contract, which is why I stress that you need a proper one.
