The guy turned up with his Dad and was in a shirt and tie and throughout the proceedings had his head down and looked (or appeared to anyway) remorseful.

The threatening behaviour part was the main thing I wanted him to be found guilty for - but without the race part, I wonder if it would have got this far. Or is that too cynical?

Nope, I thought exactly the same thing.

In terms of the CPS, "racial" seems to be a magic word. I'd bet the farm that without the aggravating race-related element, it wouldn't have gotten as far as this.

Just to conclude this, I have received details of his sentencing:

Sentence said:
At the trial on 29th October, 2015 at Shorpe Magistrates Court, [Name Removed] was found guilty of the charges:

1 Use threatening / abusive / insulting words / behaviour with intent to cause fear of / provoke unlawful violence
3 Racially aggravated fear of violence - words

The sentence was as follows:

Ordered to pay compensation of £60.00. – This is administered by the Hull Magistrates Court.

Ordered to pay a criminal courts charge of £520.00.

Community Order - this means that he will be/have to

OPTIONS:

· Rehabilitation Activity Requirement: Offender to comply with any instructions of the responsible officer to attend appointments (with the responsible officer or someone else nominated by them), or to participate in any activity as required by the responsible officer up to a maximum of 10 sessions

· Supervised by the Probation Service for a rehabilitation period of 12 months.

Good result, but I dont understand why calling someone a racist name is worse than threats to kill someone.

Obviously, great result for JTW well done - BUT, I also find it strange how far this thing got with no independent witnesses and a not guilty plea.

No independent witnesses but, no previous knowledge between suspect/complainant so why would complainant have reason to make it up?

I'm guessing here but suspect probably has previous convictions JTW doesn't so bad character application could be considered and JTWs will be credible as a witness. Def. possibly not.

What's brilliant is that you can tell your children that the mean man really has been dealt with by the police and a judge, and that he won't do it again.

I think that's important for children to grow up with. The fact you dealt with it in a sensible way and reported it is a credit to you, James.
