Our Postman is Sueing Us. Apparently.
Discussion
I love this country and I love our postal service even more.
When we bought and moved into our new flat in April the post arrived at 10ish in the morning, these days it's more like 1pm.
We've had all the posties on strike like the rest of the country on and off for the last few months.
And now.....
We had a lovely letter this morning from our friendly local solicitors Screwem & Howe informing us that back in January of this year our jovial Postman Pat managed to stumble over a few loose and missing tiles outside our front door (loose tiles I might add that every other person has managed to step over or on just fine) and twisted his ankle. Seems the poor fellow also managed to damage his back and had to have a month off work among other costs including the loss of a months use of his golf club membership!
Anyway, 11 months later and it seems we've been negligent, it's all over fault and it's time to pay up!
I can't wait to see where this one goes, we didn't own the property or have anything to do with it when the incident took place and I'll be letting S&H know that in the morning, in the mean time I've passed the letter up to our upstairs neighbour who's still in touch with the former owner of our flat downstairs and we'll take it from . As far as I can see we've got nothing to do with his and it's down to the people who owned the property when the incident occured yes?
God bless the postal service.

Funny enough my mate's mum is being sued by their postman, for having icy steps. He fell from the 5th step and jarred his back. Frankly it must have been one hell of a fall because she only has three steps to her door........
Perhaps it's a new way for them to boost their incomes, better than striking?

FFS - is this for real?
No doubt Screwem & Howe are members of 'Injury Lawyers for You' or some such scammy organisation promising 'no win, no fee' Christmas bonuses to these poor chaps who gave up some of their overtime to go on strike?
Surely, though, if they were injured in the course of their work, they should be claiming against their employer, no? Then it would be up to the Post Office to make a claim against you if they should see fit?
Or have I got that all wrong?

have the post office the right to step onto your property without an invite, would that be included in their charter, that to deliver the mail, they have to, in effect, commit trespass to do their job?
here's another one...if my postie, in the deliverance of said mail, sticke her hand through the letterbox, and Murph the Mental lab has her fingers off...can she sue me??
Any lawyers in the house -

There is an implied right of access which covers legitimate callers. The fact you have a letterbox is enough to suggest you are inviting people to deliver post.celticpilgrim said:

Seem to remember there being a right of passage for those doing work where it may involve crossing someones property, Posties, gas, electricity etc. Thing is, the injury claim should surely be the postie against the PO themselves as the postie should have assesed the risk before entering the property and he was carrying out work for them, not you. here's another one...if my postie, in the deliverance of said mail, sticke her hand through the letterbox, and Murph the Mental lab has her fingers off...can she sue me??

Hmmm..OK, MM64, we have to play this one clever. Counter argue with the the fact that while it might look like a letterbox, it's actually a plaice-flap for "Fins the fish"Gassing Station | The Lounge | Top of Page | What's New | My Stuff
