A nice start to the afternoon,

Receive a phone call from previous insurance company in which there is an ongoing 50/50 claim from the end of last year in which our wing mirror touched the side of their vehicle at about 5mph. Not only is there an extortionate £7k damages claim but now a whiplash one added to that as well.

Pretty darn annoyed people are allowed to do this, guess this is the reason for premiums hitting the roof!mad

Didn't I read somewhere they are clamping down on this type of nonsense and people were starting to get ficticious whiplash claims chucked out now when the opposing party put up a bit of a fight?

It would be cheaper for the insurance company to pay for a lie detector test instead and expose the cheating scumbags.

What has your insurance company said? I expect you've told them you clipped a wing mirror laugh One can hope common sence is applied.

Also, if you had proof that their claim was fradulant, wouldn't this be a criminal offence?

To be honest at first I was extremely annoyed, especially as they wanted £2k cash to repair it, even though there was maybe a tiny scratch (no dents or anything like that and wasn't down to primer) which would've cost a couple of hundred at most even with the most expensive quote.

They've gone through an accident claims company, nearly fell over when I was told claim was just under £7,000. This isn't a particularly expensive 4x4 either, worth about £11k trade value so nearly a write off apparently! Just find the whole situation a bit of a joke, but nothing more I can do other than let the insurance deal with it.

So, possibly end up around a £10k payout for a wing mirror scratch, I can go take a picture of the damage on our car if anyone would like to see it furious

It was our wing mirror which clipped the side of their car, wasn't even our fault but with no witnesses apparently it'll go 50/50 or fully against us as they claimed we pulled out on them. Nightmare!

fk that I would be telling my insurance company to fight that claim 100% and then question their morales as to whether it was in fact a 50/50 considering they are lying about a whiplash claim.

I'm surprised you were able to change companies if there's a claim outstanding?

Is this the one where you were both insured with the same company, and they said it was your fault?

Don't worry, I have but dragged on for nearly 6 months and start to lose faith with the fortnightly calls for updates where no progress has been made and no resolution despite an accident repair center and a close family friend who owns a prestigious body repair shop, specifically stating our car could not have caused such extensive damage!

Going to take a photo, just so you can really see how minor this is!

Yup, both with same insurance. I'm still with the same underwriters, but was able to change fine, declared it as an ongoing claim with an estimated payout. Lost NCB for this years insurance though, even more frustrating!

did you get any pictures on the scene?

and I would be interested to see the 'almighty' damage to your vehicle.. hehe

Seriously it cannot possibly be this difficult for a broken wing mirror and a scratch. I take it you sent your insurance company a picture of the damage? And the third party's insurance company. If its as trivial as you say, anybody with eyes can tell its bullst confused

May i suggest writing to both your local politician about this as well as watchdog and the minister who recently commented on the clampdown and cc in your insurance company.

Wing mirror didn't even break, tiny scratch on it as it folded in. Yes accident repair center assessed and has sent photo's; I believe actually that no photo's where ever taken or obtained in relation to the third party's damage, I kicked off about this got no where. Yeah I have stated many times to them it's a joke. Photos below:

It's so minor the camera doesn't really pick it up either. You wouldn't notice it unless you were right up close and looking for it. The list of damages includes wheel arches etc on their vehicle which would be impossible with contact only being made with the wing mirror.

Out of interest: can you personally sue them for fraud, separate to any insurance settlement? I guess their insurance may give them legal cover for that.

Seems to be the norm these days.

My uncles dog got hit by a car at 15-20mph, got up shook its head and walked off.

Women who hit it is claiming damages, and you guessed it......PERSONAL INJURY!

Dog shouldnt have escaped out of the garden, my uncle totally accepts that.

He phoned the insurance company to let them know the road is access only, and she isnt a resident. was taking a shortcut to work. So i doubt nothing will come of it.

Its absolutey disgraceful, but sadly its the way society is these days.

I'm not really interested in that route, just a bit annoying that I may end up with a 5 figure claim on my record for 5 years, plus losing NCB. Looking to change my car soon and all this will increase the premium by about 70% frown.
