...which is a PH Law. Every thread on this subject has to contain at least one reference to Arkell v Pressdram. (Not Safe For Work)

If we were being cynical we'd say that he has removed the invoice from the documents which proves the work was done then he wants money off because "no such work was done".............

So he won't be calling any company to verify the work was done at all.

Buyer arrived checked, handed over cash. Deal done. Tell him to do one. Why didn't he have an independent check up on it before handing over the dosh? You are under no obligation to give any cash back.

Except that,

  • Seller seems to have separate invoices for the parts and the labour. Why?
  • Buyer has had an independent check which says the work wasn't done. Is that correct?
If the seller's been trying to pull a fast one the buyer will be able to make a valid claim.

Ok, so what is claimed to not have been done? How much does buyer want back? Surely though, on a car of any value from a private seller its down to the buyer to check everything out properly before parting with their hard earned?

Parts bought from one company (e.g. GSF or ECP) then taken to another company for fitting?

I shall give those interested the abridged version:

I advertise car
Buyer calls me, asks questions, agrees on a price and sends me a deposit
Buyer arrives on train, I collect from railway station
Buyer happy with car, pays balance due, signs V5, drives away
Next day I get an email to state that the work I have 'claimed' to have had done on the car has not been done
Included in the paperwork given to the buyer was an invoice for the work I had done on the car, including the work that the buyer has claimed has not been done (as well as a separate invoice for the parts needed to complete the work)
Buyer gets independent check done on the car which sides with the buyer
Buyer contacts me, wants me to pay for the independent check
Buyer also wants a part refund of the sale price so that they can get the work done themselves (amount not mentioned in initial emails)

Where do I stand in all of this?
