Fault is with the van for pulling into someone's path, they are joining the road so it's up to them to do so safely.
Rider could have prevented it by riding slower and being more careful, but would the van have seen if she was doing 30-40? Probably not.
You're right, the van probably wouldn't have seen her. She would have much more chance of stopping in time though, which is the primary reason for keep the speed differential lower in situations like that - to give you a better chance of not hitting an idiot.Rider could have prevented it by riding slower and being more careful, but would the van have seen if she was doing 30-40? Of course, the merge point wasn't far away either so riding like that is daft, but saying the van driver is only partially to blame is nonsense.Janesy B said:

So how does that work then.....do we now absolve people of all responsibility for their Darwin like actions in life ?The legalities of motorcycle accidents when motorcyclists are passing traffic aren't straightforward anyway.

100% van drivers fault, however better road/lane positioning would have significantly improved her chances. Why wasn't she hugging the outside verge? Positioning is decided (in order of importance) by Safety; Stability; View.A bit beardy I know, just offering many years of training and experience for any newbys watching.
Wish I had a rear-facing camera as well as a front one, I'd have had some amazing footage today...

As I started to pull out onto the Crosshands roundabout, I heard a clunk sort of noise like a HGV makes as bits move; I looked about to see if there was a lorry I'd missed joining me that I would want to be aware of on the RA.
Instead, in my rearview mirror, I saw the underneath of a pickup as it flew gently towards the space I was just leaving.... it must have hit the ground, gone straight through the fence and chevrons and I think I saw it parking on the top of the bank in the picture. God only knows what speed it was doing and how it managed to get air without hitting anything else on the way!
If I'd not kept moving, this could have been a very different post...

I think the best way to explain it is this:
The car driver is 100% at fault for actually causing the accident.
The biker could have ridden more carefully to reduce the chances of that kind of accident. Just as I was watching the video I already knew what the accident would be - someone either merging from left-hand to right-hand lane, or someone not checking as they turn across the carriageway.
Riding past a queue of stationary traffic at 60mph is far too fast.

To me it's the same reason you don't pass parked cars quickly on a street. Would give some benefit of the doubt to not being able to see the turning on the left, but the shape of the central bit kind of implies the other carriageway can turn... you can't ride near normal speed past traffic like that just because it looks like the road is clear and it's an NSL, especially as there was clearly some sort of junction.
I've learnt recently to even be careful of queues on the other side on a single carriageway..
I drive back up here https://goo.gl/maps/pTEUW2TCdGE2 every night, and if anyone knows it, there's often a queue from roughly this point right down to j22. I'm not always going that quick out of the roundabout, as someone joining the queue from the Weston road probably cut me up... but I'm wary of people going over the line to get in the A370 lane early so won't accelerate much. However I would get to 45-ish by the time it's back to 2 lanes. Not now I don't...
Lexus RX appears suddenly turning out of the queue in front of me to U turn, subsequent new brown drivers seat when I realise I can't stop in time, and manage to avoid his rear 3/4 just as I get the last 5-10 mph off. Notice how close this all was to the clearly signposted roundabout...

Can you lot fk off and create you're own thread to have your petty squabbles and leave this one for the subject matter.
Much obliged.
This! 100%Much obliged.
SIX fking pages chatting st about cyclist and motorbikes. Any footage involving a cycle or motorbike needs to fk off to another thread.

I am sure that the cyclists can work out for themselves what balance of pleasure/safety they wish to apply. I can fully understand how they would prefer to ride in a group and chat rather than ride singly in silence. We do the same when we choose to drive at 70mph or more instead of 30mph.
Weasel words. As I suspected, you can't actually justify your position. If cyclists don't want to practice defensive riding because they prefer to chat to each other, then they shouldn't whinge about accidents that would have been avoidable if they had. Not excusing crap driving in any way, but all roads users have a responsibility for safety.More crashes from around the globe (ish)!
