private car sale and deposit taken - can i change my mind?

Having second thoughts about selling a car. I have taken a deposit though (and given a receipt), with the balance agreed to be paid at the weekend. Can I simply say I've changed my mind and return the deposit, and apologise of course?

Did you provide the buyer with any kind of written cotract which he signed?

We both signed a written receipt for the deposit which detailed the agreed price for the car. Not sure if that constitutes a contract.

I would explain the reason to the buyer, not fake a fault or anything else.

Because my wife was in floods of tears after the fact, and I also now regret what I thought was the right thing. An honest, uncalculated error (for the self righteous on here).

You can try.

But I'd suggest a negotiation.

He will probably have to readvertise it, incurring costs. He may have turned down other sales.

Ring up, be polite, be truthful and ask if he would consider returning your deposit minus his incurred costs.

Well it's late...

I'd offer it all back and a few quid extra to cover the buyers costs in fuel etc.
Worst case is he could sue I guess but only for actual loss.

Bit OTT and I think it depends on the situation. If it's the next door neighbour who agreed to buy it on a whim then it's less of a problem than if the guy has travelled from overseas to view and purchase the car.

It's an unlucky situation for both of you but I would go with an apology, deposit back and some sort of compensation depending on how much it inconveniences the guy,

I would be very happy to cover travelling expenses for the viewing, which apart from the disappointment, would be the only inconvenience.
