I don't believe this.......again.......

A couple of weeks after FINALLY getting Mrs G's car back from repair. After a woman mindlessly reversed into her.....
Someone has done it AGAIN.
She was waiting at end of the [private] road that leads to our house. And someone hit her from the left. Crushed the bumper and absolutely totaled the side of THEIR car.
This time the insurers reckon its either split fault or Mrs G's fault....[!]
What the
else should she be doing when joining a road ??? ???
ers. There goes the no-claims.
ETA: Just goes nicely with the
ing £300 respray where a PH Decal took my laquer off...
I
ing hate this month...I'm going to the pub....

A similar-ish sort of thing happened to an aunt a while ago, waiting in a queue of traffic when the driver in front decided to give up and turn round; of course he starts out by reversing up, and... crunch.
What happens is the other driver writes, "the other car appeared out of nowhere and I hit it", or words to that effect, on the form. Not necessarily a lie, just an economy of truth.
Next we know the other insurance company has said, "According to the account, your client was moving at the time of the accident", and my aunt's insurance company just says, "yes, whatever, knock for knock then" as they are wont to do.
Can you challenge them? I would have thought hitting a stationary vehicle stopped in a predictable position is pretty inexcusable.

Some imbecile nearly reversed into me last week, in the cinema car park. Must have spotted a space somewhere, because without warning they stamped on the anchors, stuck it in reverse and then almost reversed into me. Only avoided by leaning on the horn, and they must have missed by inches. Can't have had a clue that there were cars behind them.

Classic example of them not using their mirrors when reversing.
Only remedy is a swift kick in the balls, I'm afraid.
So from that picture is this description right, your missus poked her nose out to get a view of the road and someone driving down the road didn't change course to avoid her? Despite the monumental stupidity of not steering slightly to avoid a collision wouldn't that still be fairly your missus's fault?

She positioned herself in order to see what was coming....The alternative being what ?
Don't you think the other driver might have stopped / slowed / steered into the ample area that was unoccupied by car...?

I agree on both counts, that there are junctions you need to poke your nose out of to see and the other car should have moved, but I can see why insurers would say it was at least split fault when your wife has moved into the other person's path. The alternative being what ?

He was waiting to come out of a junction with cars parked on both sides of the pavement nearest to him on the road he was about to drive into. He edged his nose out, saw a car coming and though "I could make the gap but I'll stop". He waited about 2 or 3 seconds to see this other car carry on straight at him without an hint of slowing or steering out the way! The end result was the other car tooted his horn just as he hit my mate Dom!

Insurance company blamed my mate.
