Someone has nicked my car (picture)
Discussion
There is this picture of my car on a website.

That's the pic on my flickr site. This is the website: http://pic3.piczo.com/carnumbers/?g=10629035
Not really a problem - it is in the public domain, but on the site they have this disclaimer:

Should I be afraid or is this just the Internet? Please seek permission before copying any images or text.

My car is on there too. Their disclaimer is a little cheeky as they didn't ask my permission to use my photo so I've no idea why they think they have rights to it now! However, I'm guessing it's just a standard thing they put on all pages through habit.
I've emailed 360boy in the past - he's a good chap.

Yes but some naughty little web designer is charging them for the use of the picture
To be honest i would actually inform them that they are using YOUR car picture and you want to charge them.
Send them a bill and say they pay you or send it to your favourite charity
They can either pay you or get the lawyers out
If they roll out lawyers forget it if they don't then you have a wee bit of cash.
And their web designer gets his ass kicked

But if I've posted the pic originally on a PH thread, have I not put the picture in the public domain at my own risk?To be honest i would actually inform them that they are using YOUR car picture and you want to charge them.

I'd be honored if I was you, there are some cracking cars on there and yours is one of them, they haven't got the best bit on there though, the sound, that would beat the lot of them.
At the end of the day we drive on public roads and anyone could take a photo of our cars and do what they want with them, we also do shows to show off the car so nothing is really private, just stick with been honored with it been on there.

i think it is one of thoes web based problems.
i had some pics over 60 nicked from my own web site ( www.davewoodall.com )
from the canonball run this year some cheeky Fu@@er put them on a car related site
in the states it was speed something. Anyway i emailed them as they did have copyright on them,.
but basically they told me to F..... off and they were sorry etc but this was only after a legal letter went
of to them as the copyright was held by a magazine who payed for me to do the shoot.
However if they nicked your pics i would be cheeky and bill them a usage fee for them .
just send a e-mail invoice for say £50.00
nothing ventured as they say

I agree Kev - and I'm less concerned seeing as it is a PHer.At the end of the day we drive on public roads and anyone could take a photo of our cars and do what they want with them, we also do shows to show off the car so nothing is really private, just stick with been honored with it been on there.
However it's the claim of ownership. If someone photos the car out in public then at least they have made a bit of an effort! And they would 'own' the photo. Besides I have got much better photos that could be nicked.

If you did not write or create the article, graphic, or data that you found, then you need permission from the owner before you copy it, otherwise you are technically stealing it.Quoted from a copyright article my dad has lying around.
A photo of my car was on PH (without permission)... but I've just noticed:

On your Flickr page at the bottom right will be licence information. Now if you don't preset it, it will default to 'all rights reserved (edit)' which basically means that the site you linked is guilty of copyright infringement.
If you don't want them to use your picture then you can email them and insist they remove it. If they fail to do this, then an email to the domain holder will see the problem solved.
If you're happy for them to use it, then you should edit the licence on Flickr. Change it to a creative commons sharealike 3.0 licence, that will allow people to use it, provided they give you accreditation where used. You can specify commercial or non-commercial licences.
It will take you 10 seconds to do this, its easy.

Copyright on flickr is 'All rights reserved'. Doesn't that cover my ownership?
I don't really mind it being on a phers site, but their disclaimer is a bit dodgy. At least it is on a 'cool cars' site rather than 'look at this idiot who overtook me when I was merrily doing 40 in a NSL' site.

Hi guys.
Sorry if I haven't responded, but I never even saw the thread.
The copyright notice on the site was originally meant to cover the images because most of them were taken by me or given to me by customers to whom I had sold the number in question.
However over time, I have been send thousands of images from third parties for inclusion.
It is impossible to check with every sender to establish if the image was taken by them. Obviously some will slip through the net.
Since I started the site, I have only been asked to remove three pictures. This I have done with no question.
If I have offended anyone by including their car on the site, please let me know. I will gladly remove it.
At the end of the day it is a very light hearted site and not meant to be a text book refence of the contry's cherished numbers owners.
Judging by the comments on the "guestbook" page, most people like the site.
If anyone wants to add any pictures, you can contact me via my profile.
I will not post the website here as I am liable to get banned, but you can find it in my profile.
Thanks all.

Intellectual Property is a really grey area especially when concerning the internet. I used to deal with this sort of thing quite often as a couple of years ago I was in the game of producing lots of visual media which was stolen now and again by other sites. Basically as the photographer you own the rights to the picture and if another site lays claim to it you can request that they remove it - if they refuse just speak to their web host and they should sort it out. However these laws also conflict with the Fair Use Policy which can start to muddy the waters a bit, especially if there is money involved (i.e. either you were paid to take the pictures, or the thief is making money off them, or both).
