Hi,

Bought something of ebay on the 25th of August and was dispatched the same day through 1st class mail. Still not received the item, I've contacted the seller and he's basically said not his problem, he's got proof of postage, so PayPal will side with him.


Is this true?

No
contact Paypal and tell them you havent received the item, you should get your cash back

His problem and stupidity for just opting for first class mail, chances are he's not even posted it.

He has to prove it is DELIVERED not sent.

Start a case on eBay. State what you know, if he doesn't provide this proof you'll be refunded.

I've just messaged the seller telling him its his responsibility for the item to get to me. If he cant rectify the problem I will be opening a case on ebay.

Just open a 'not received' dispute. As part of this you either request the item or a refund.

If you want the refund and doesn't volunteer Ebay will refund you after 7 days.

I wouldn't give him the option - just open the case - he has to provide proof of delivery (which he can't as he skimped on postage).
I would only use First Class for low value items - I don't expect to get diddle by someone with good feedback on a £50 item.

just received his reply,



Hi,thanks for your kind consideration.We have already sent you a replacement to your address. If you will not get your item or any problem with the item,please contact us immediately.We will try our best to solve your problem.
once again,we really apologise for the inconvenience happened.

NB: its written “Replacement” on top of the envelope.

Just a thought,you only have a certain amount of time to open a dispute. He could be stalling until the time elapses!

Thanks for that. I'll wait till Tuesday and see if the 'replacement' does arrive, if not i'll open up a dispute.
