I reported a colleague yesterday through the appropriate channels for doing something dodgy, really really dodgy

She's been with us (big company) for over 10 years and has a reputation for being poor but as far as I know has never been the subject of any disciplinary action

I thought it would be a simple matter due to the nature of her transgression but on arriving at work today have found out she's reported me for racist abuse and bullying

Anyone got any experience?

Cheers

Yeah, I've been a racist bully at work for years but appear to have got away with it.

To be serious, you need to know what you might've done and what evidence she has; her word against yours, previous complaints she's made to HR etc. Any witnesses to this? (careful she may have dragged a mate in to "help")

It is entirely possible that she is expecting getting a warning or maybe fired (we don't know what it was she did) and has flipped out the racist card as part of a potential future tribunal claim against your employers.

My advice, keep quiet, say nothing incriminating and be properly represented in any meeting with your firm. Even if you say something "like oh yeah sometimes when I get in to work I may bit grumpy and stressed and perhaps I can be a bit short with her, I suppose, never really thought about it" will potentially undermine you - unless you conduct that exact behaviour with everyone else in the firm.

- Good luck.

I got reported for bullying after telling one of my reports that spending 15 minutes out of every hour in the smoking room was excessive, I ended up with a written warning smile

She will be in major trouble after my complaint, possibly even fired

I have never lost my temper or shouted at her even when I saw the deed done so there can be no previous however am concerned about possible witnesses being dragged up to support her allegation

If you've got a whistleblowing policy that should trump anything that might come your way. It needs to be realistic, as in someone fiddling their mileage for example might not fall under the protection you'd get from a whistleblowing, and based on the info you've supplied I dont know one way or the other if you'd have protection under that. Your contract would tell you

I'd imagine as long as you havent done or acted with prejudice towards this persons race or ethic beliefs, you're pretty much clear

A bit OT but it is due to racism; I have a couple of colleagues who are racist and it it is getting to the point that I'm getting increasingly fed up with their ill informed racist rants about immigrants, terrorists, muslims etc, now there is no one at my place of work who is what you may class as an ethnic minority; basically for all intents and purposes we are all "white British".

Am I able to make a complaint, even though the rants and racism doesn't directly affect me?

IIRC you can (same as you can for sexual harassment even if you're 'only' a witness)

Care to shed any light on the nature of your complaint? Purely being nosy of course.

I've seen the racist card pulled and it nearly ended the senior guy on the end of it who is not a racist. The young buck pulling the racist card has gone on to very big things and is now completely bullet-proof.

My wife was a manager some years ago and had the race card pulled on here by an underperforming employee who then tried to pull the accompanying bullying card and tried to take them for several thousand after being dismissed for non-performance.

She got nothing, fortunately because my wife is a pain in the arse with data and kept every single email conversation they'd ever had which = no bullying, no implied racism anywhere over a 3 year period, just the raw data saying she was basically st. Was a worrying time though, its a big accusation to overcome.

I have also been accused of it by an employee.
We were in his probationary period end meeting and he was useless so I had marked him as such so out came the racist card.
Management knew it was bks. I then had to put up with him on my team for three years.
He later admitted it was made up when he jacked but the damage had been done.
Couldn't stand the man after that and after he threw the card out you couldn't touch him even when I showed a video of him stealing gear from work no action.

Not a nice place to be on the end of it.

This is one of those situations that shows whether your HR dept are the shower of shyte you expect, or have experienced them to be.

Happened to one of my colleagues. It wasn't fun as she was one of the nicest people I knew. The problem was, she wasn't a walkover like the accuser's previous line managers, so she was prepared to challenge poor performance.

Accuser took us all the way to ET where it was thrown out. However accuser was simply redeployed to another role.

Many years ago, I was hauled up in front of my Sergeant Major accused of being racist to one of my crew.

"Cpl Issi, Private Brown has complained that you won't let him drive the fuel truck because he is black"

"Sir, Private Brown does not possess an HGV driving licence!"

" Oh, OK then, off you go and send Private Brown in to see me"

Cue lots of shouting.

The firm I work for can't be accused of racism as they don't employ any black people.

Interesting.
She can make accusations but unless there is PROOF then this is irrelevant. as said make sure you are represented properly in meetings.
Bring in a work colleague as an independent witness.
Keep us updated.

Has she reported you because you reported her?

Well as her allegations are utterly groundless then I would have to assume so

Quiet statement gathering going on by HR

Nothing else to report yet

While you can I would probably shut up and tune out.
It doesn't effect you directly.
