This caught my eye from our local paper...

I thought it was an automatic ban, as for Drink Driving?

Maybe the courts just wanted to plough through the list that day. Quite a farmiliar story.

It's possible that he refused the roadside breath test and then gave a substantive breath test or blood test at the station which was under the limit.

Not enough info in the local paper to draw any conclusions however;

Fail to provide whilst in charge (rather than driving/ attempting to drive) carries a lesser sentence.

Fail to provide at the roadside (preliminary breath test) carries a lesser sentence (there's no power of arrest unless there are reasonable grounds to suspect a person has alcohol in their body).

Fail to provide specimen for analysis (in charge) - discretionary disqualification (of any length) or 10 points.

Fail to provide specimen for analysis (drive or attempting to drive) - mandatory disqualification of at least 12 months.
