Not enough info in the local paper to draw any conclusions however;
Fail to provide whilst in charge (rather than driving/ attempting to drive) carries a lesser sentence.
Fail to provide at the roadside (preliminary breath test) carries a lesser sentence (there's no power of arrest unless there are reasonable grounds to suspect a person has alcohol in their body).

Fail to provide specimen for analysis (in charge) - discretionary disqualification (of any length) or 10 points. Any ideas folks....
Fail to provide specimen for analysis (drive or attempting to drive) - mandatory disqualification of at least 12 months.
