Could or would the UK ever leave the EU court system to set and legally enforce its own British Bill of rights?

Not according to Ken Clarke - he also has previously expressed his strident views on the concept of a British Bill of Rights.

Would be quite a feat to leave something that doesn't exist; there is no EU court that has human rights jurisprudence. The European Court of Human Rights is a completely different animal from the EU.
And, given that the European Convention on Human Rights was a product of drafting by UK lawyers, I imagine we will be subscribing for some time to come...

The Tories can't do anything while in coalition with the Lib Dems a purely Tory government would perhaps be a different matter. Thatcher went into the ERM and Major signed the Maastricht Treaty.
