Interested to hear if the OP did get his drink back afterwards...

I stayed in a hotel in Spain last summer and we had spotted the small print but some other customers hadn't judging by the arguements we overheard at reception: If you put anything in the fridge/minibar then they charged you 5 Euros per day. Someone we met had put a small bottle of water in his fridge and left it in for the whole 10 days stay and was charged 50 Euros for it!

The did try to charge us for putting a bottle of wine in ours but as we'd bought it in their bar we questioned the charge and they removed it. It was a great hotel otherwise, so this kind of money grabbing approach just took the shine off it a little.

It's straight and simple, the T and C's are unenforceable bullst

There are far too many people that believe if its down in black and white it's the law

For example, the chap who took a deposit for a B+B stay from me about 1 year prior to the stay and then when I cancelled approx 9 months before and asked for the deposit stated "we don't refund deposits, it's in the T and C's"

Now admittedly, it was in the T and C's, and quite clearly but I wasn't about to hand over £150 for nothing (especially as I'd lost my job at the time!) as I thought he would have MORE than enough time to re let the room

Appears that the OFT agreed with my position, as did the judge at the small claims court

So, just because it's in the T and C's doesn't mean it's right

As many others have already said, I'd be kicking off BIG time if the hotel pulled this particular stunt on me - as far as I'm concerned once I've paid for that room it's mine to do with as I please (with the exception of damaging the hotel's property or being a nuisance to other guests).

I stay in high end hotels around the world constantly (well over 200 nites a year), and I have never encountered anything remotely like this - even in independent or boutique places - and I would be kicking off big time if somewhere pulled a stunt like this, not to mention leaving immediately.

Next time, do as I do in every single hotel I ever stay in, and put the do not disturb sign on the door the minute you check in, and leave it there until you check out. Eliminates crap like this totally (as well as housekeeping wake up calls). If you need fresh towels or whatever just phone down for them.

Excellent post. ]

This is an unenforceable contract, if in fact there was a contract. The OP should issue a claim they will fold.

The publicity, alone would be very bad news for them.

If I stayed at a hotel and they tried to charge extras I would pay for the stay minus the extras with cash, if they took card details then report it lost and get it blocked.

That is not really the best way forward. You are misleading the Credit Card company. Which is most unwise.

I've had the misfortune of staying at the Belfry with a few of the boys. They should be more concerned with stopping the "company for hire" in the bar/club area.

I don't think they are. A football ground states that you can't bring in your own alcohol, yet they sell it in the ground.

A hotel can state what it likes, as long as it's within the law.

But does that give them a right to search your belongings without you present?

I don't know. I'm just saying that they can ban alcohol if they want.

You'll love it. When I last stayed there, thanks to an accident at 3am, my entire party was frog marched into the car park and threatened with police / arrest by their management team.

I will never go anywhere near the place again.
