Hi all, I just signed up to PH so I could ask some advice... I was trying to post in the law part of the forum but it won't let me!
I was driving home from work tonight when I heard a big bang on my roof, I couldn't believe it so pulled over to see if what I thought had happened had actually happened...
End result... A branch say of about 50-75mm in diameter and around 300-400mm long had fell out of the tree at the exact time I was driving past... Im so pissed off by this as now I have a dint in the roof of my 2011 cooper SD...
Can I claim damages from the council for this?! All advice is welcome please!!

I'm afraid councils are only liable if a branch is longer than 401mm. Sorry.

God is trying to kill you. Alternatively, this could be a 'Final Deatination' type scenario and you will have to pay the piper at some point. Beware of buses, leaking fuel, roller coaster, trains, k Ives, cars, axes, electrical sockets, more trees, and so on. You could die at any moment.

Councils have a legal obligation to inspect all trees daily for defects. Get down there in the morning and demand to see their records to verify that this has been taking place. I bet that the lazy b  ds have been slacking.

Count yourself lucky, I was with a mate once when a branch fell and went straight through the back window!!
