In instances such as this, the 'victim' will pretty much always be arrested if an assault has taken place, as a formality until it is established exactly what has happened. Arrest is different to charges and convictions.

Therefore even if you did legitimately beat up a rapist or burglar, expect to head down to the cop shop.

It happens all the time but is usually dealt with by embarrassment and lots of apologising.

Yes, we all like the idea of beating burglar scum to death, but when it comes down to it, the situation of State administered justice is a much better idea than just handing out guns in primary school and letting the people police themselves.

Still, nice of the guy to believe his girlfriend's story about the "wrong house".

I'm obviously imagining this very differently. Assuming we believe the story is true that the pissed bloke was there by mistake (which is clearly BS) I have pictured that the "attacker" has found man in bedroom and dragged him out. I would assume he then wanted him out of the house and instead of asking politely has tried to get him down the stairs. I also imagine that if "victim" is so pissed that he goes to the wrong house he probably is not a) speaking clearly to explain the situation and b) acting in a rational manner. A pissed body builder is more than likely to instinctively fight back. Remember, the "victim" thinks he is in the right house being attacked by an intruder!

I do not think we should allow people to mercilessly beat people but pushing a potential burglar/rapist down the stairs is not mercilessly beating someone its self defense! Now I acknowledge I live in the US, and have done for 10 years, so probably have changed in this respect but I think it is also worth me stating that I am 100% against owning hand guns, or any weapon that is not used for legal hunting. (I hate hunting as well but it is an American right).

And in the UK, a chav would kick two barrels of ste out of you, claim you were a burglar, and get off scot free.
