I don't think that counts for st tbh.

Could be remorse, could be waiting for the alcohol level to drop as I believe that's a common reason for doing a runner even from minor accidents.

But as we don't know why speculate?

Making the wrong decision in the heat of the moment after a serious crash when you maybe shouldn't have been driving is a pretty human response I think.

Would a high Alcohol reading make much difference to the potential charge and then punishment if he's found guilty?

Its already been stated the driver was not the hirer, and was under 28, so was not insured.
Probably when he told his cousin/bother/or whoever hired the car for him what he'd done they made him go to the police

It would definately make some difference. Could even be a different charge with a higher maximum sentence.

So, the charge list...

Driver
Excess speed - Physical evidence from the impact damage.
Damgerous / Careless / WoDCA.
Failure to stop (doing a runner).
Failure to provide details at the road side.
TWOC / Agrivated Vehicle taking.
Without insurance.

Renter
Causing or permitting no insurnce by allowing the drive to take the wheel.
Anything else?

Potentially quite a bit.

Death by careless driving = maximum 5 years in prison.

Death by careless driving while under the influence of drugs or alcohol = maximum 14 years.

If it was death by dangerous driving it wouldn't affect the charge or maximum sentence, but it would still be an aggravating factor.

Renter will just claim vehicle taken without his knowledge

There won't be much of a list and the indictment won't be populated by summary only matters.

You don't appear to be familiar with the totality principle.

One person died, at least one other was injured. The indictment will reflect this.

Could he have insurance though? Renter gives permission to him, covered 3rd party by his own insurer. I know the hire company would have a fit if they realised that was happening but could it cover the driver purely from a legal point of view?

Doesn't the driving other cars extension normally refer to '....with the consent of the owner....' or similar words?

Tragic of course.

But more annoying is the vast majority of the comments on the Mail website - all the time it's the same old st from idiots who think because a car can potentially do 193mph that it should be banned.

Wake up and look at the facts, the incident appeared to happen in a 30mph limit so even a car limited to our upper speed limit of 70mph would still kill someone when travelling at an excessive speed for the conditions.

FFS when will people figure this out.

You are coprrect in guessing a lack of legal training and thank you for the correct term. I am aware of the CPS going for the big ticket charges with others not being followed through or being presented as aggrivating factors.

My main area of interest is more around the renter. Claiming it was taken without consint is a likely defence but I was wondering about other possible charges.

Sadly, it's the initial response of running that defines a man for what he is deep down.

Maybe there was an armed mob, probably not.

The handing of oneself in all likelihood is after its been assessed as to whether he could get away with it or not.

The initial 'story' does seem to intimate disrespectful scum hires car and lends it to another scrote who realises he will be easily traced so surrenders.

Hopefully the reality is nothing like that.
