I wouldnt know,ive never been done for parking. Thought it might help the op tho.

These threads really wind me up. How a land owner is supposed to control it's estate I have no idea.

I'd like to see the law amended to:

1. Clear Signage.
2. If the driver breaches the signage
a)An early resolution process for simple mistakes over taking the piss - e.g. if you had bought something from M&S, produce receipt. Ticket cancelled
3. A fixed fine laid in statute to shut up Peppipoo about 'loss'.
4. Either clamping allowed to identify the driver (then removed with fixed fee to be recovered) or Registered Keeper remains liable.

Banning clamping has got rid of the cowboys, but left car drivers to take the piss.

I had one of these at Morrison's in Inverness. All the Morrison's where I live have free car parks, so I parked up there and went inside for something to eat in the cafe. When I came out, there was a ticket for failing to pay and display. I walked the route I came in, as well as the route to the shop, and not once did I pass an obvious sign. They were there, but all the ones I passed were sideways on and the same colour as signs for the trolley park etc. I would have at least expected something at the entrance.

I emailed them explaining the reason why I did not pay and why I was not going to pay their ticket. I worded it as a statement rather than a request for them to cancel the ticket. I got an email back saying they had accepted my 'appeal' and cancelled the ticket, but may not do the same again.

Why are you bothered so much? Somebody innocently parks on a car park believing it is free for customers (which it turns out is, via a voucher). The shop incurs no losses whatsoever and the customer wonders if he can avoid paying a ridiculous charge for parking. It is not somebody dumping his car on M&S car park and pissing off to work. Yes, there are some who take the piss, but the OP is not one of them.

What laws are they? The penalty is based on normal contract law and an implied contract between them and the OP.

I'd suggest first go to M & S customer services and complain . I got one from Asda for five hour parking in their park where it was a half hour first visit and another some four hours later. Quashed. Then I saw a leter in our local paper from a lady who shopped, ( and spent a lot of cash), visited the cafe ,and other stores in the park and got a ticket for overstaying.Asda did reply to tell lady to take ticket in to have it quashed.

My wife got a demand through the post for parking in Morrisons in Invernesss when she was displaying a ticket with 15 minutes left to run, luckily she had actually kept the ticket but they still tried to demand £70 three times.
