An officer only has to 'form an opinion' that you are driving in a careless manner, and if he stops you with a Section 59 in force, then it's bye-bye car, BFH, and big money to get your car back.
I've heard of a few cases where an officer has 'formed an opinion' of careless driving, but the driver with a section 59 has not necessarily agreed with the officer's opinion. They've challenged the opinion, and got exactly nowhere, apart from incurring even more cost and stress.
I would certainly be 'Driving Miss Daisy' if I had a S59. However, I've not had one myself, and I am hopefully not ever going to suffer one either!
