Breadvan72]1. By an agreement made orally on [date said:
, the Defendant sold and the Claimant bought [describe car] "the Car".

2. The Defendant did not sell the Car in the course of a business.

3. The Defendant sold the Car as a private seller and without any express or implied warranty or condition as to its quality.

4. The Defendant makes no admissions as to the alleged defects in the Car, but such defects are in any event irrelevant for the reason indicated in paragraph 3 above.

5. The Defendant denies that he is liable to the Claimant, as alleged or at all.

6. The claim has no reasonable prospect of success. The Defendant will seek the costs of defending the claim.





If asked, the "excellent condition" was what is known as a "mere puff", and in any event an expression of inexpert opinion.
So this is along the lines of how I should respond with my defense??

You've had your Defence written by a very good barrister. smile

I'd add the bit about the test drive and check.

I know nothing about the law.

A sticky is a post that is stuck to the top of a forum (think of it as a reference post - easily found and pointed to in the event of further posts along the same line)

Personally I can't see it happening as they tend to be forum section advice threads that are stickied

have a look at the top threads that never move and are always there - they are the stickies

I would be happy to draft an FAQ list on commonly encountered civil law issues, but the Mods might not want too many stickies cluttering up the page.

The other issue is that not all sales are the same.

The advice given on this thread is after the OP supplied a rundown of the specifics of the sale and the advert.

If the specifics had been different, the situation is rather less clear cut, thus I'd actually recommend against providing this as a template for others to assume that they are in the same position.

The trailer one is useful but I agree BV72 a thread as you describe would be useful.

Alternatively what about a sort of wiki on threads by category?

I'm a bit confused

So was the car you used for work the Renault Scenic or was that another car - which means you did originally have two cars.
