Hi Folks,

When we moved into a new build a few years back, the builders got a property management company (HLM in Shrewsbury) to set up and run a Ltd company on behalf of all the residents on our behalf. All householders are share holders in this Ltd Co and pay a levy each year for the upkeep of the shared areas (kids park, trees etc).
The mismanagement of this compamy is appalling, but that a story for another day.

We're trying to re-mortgage and being asked for the share certificate. We doubt we ever had one but certainly can't find it now.

HLM want £300 to issue another certificate.

Question 1 - do I have any leagl basis to challenge this?

Question 2 - as I know all the details, can I just make up another certificate? Its for a nominal £1.00, will anybody care?

Similar situation to me, lenders solicitor have had to write to the management company and inform them of a new charge against our house even though it's freehold.

We've not been asked for a share certificate though.

I hate living on a managed estate though as our company are useless and can't get the books right. Never again

You will find it will be a real ball ache come sale time, especially with HML. I was in a property managed by them. Incompetent is being polite.
Glad I've sold and got out of there.
