Hi Pher's looking for advice,
Sat in left lane of traffic wanting to turn left. Van in middle lane (ahead only) now decides he wants to turn left and turns into my car as lights changed. Significant damage to drivers door. I must have been in his blind spot. He was very apologetic at the time. In an effort to get repairs done as soon as possible I instructed insurance company to start repairs pending official acceptance of responsibility from other party's insurers. I was reassured by the claims line of my insurer that it would not weaken my case to go ahead but I would have to pay my excess and then claim back when liability was accepted by the other party. I tried to minimise costs all round by not going through an accident management company and declining a courtesy car. I have now been without my car for 4 weeks and when I chased my insurance claim I am told that Liability has not been accepted. Now repairs are almost complete I suspect my insurance company won't argue too much and will just hit me at renewal time and mark it as a claim which I am very unhappy about. I can understand why people do go with accident management companies when you have this aggro.

any tips on how to play this?

My recent dealings with insurance are if its plain cut and simple the insurance will somehow make it complicated.

Like you I never opted for a courtesy car for the first 8 weeks, after that I did and it's still not sorted now, a mere 16 months later. The car hire charge I had for six months made my eyes water!

Is it a case of liability not accepted, or liability disputed?

At present not accepted. I can't think on what grounds they would dispute but nothing surprises one anymore

I think I would sue the driver of the van's insurance company directly and change insurance companies...

You will need to sue for your loses outside of the damage (which your insurance company have taken responsibility for). You are within your rights to claim for loss of no claims bonus and premium increases for a reasonable period (I would suggest 3 years).

thank you. just returned from holiday. My car still not repaired. now over 5 weeks. will chase my insurance company tomorrow.
