What makes you think it's for overstaying time?

Maybe it was for parking where you shouldn't to visit a neighbouring business?

Can you prove payment?

Logic would suggest you are paying to utilise a bay, so providing you have vacated the bay by the allotted time the car park operator has suffered not loss.

Why not write them a nice letter? Tell them you have their second invoice, but never had the first one. Explain that you feel it is far too much money for overstaying just a minute or two and cannot possibly represent the money they lost in that time.

If you paid for a ticket, how long did you buy? I've never seen any pay and displays that offer less than an hour at a minimum. How did you exceed if you were only there for 20 mins?

I definitely would not!

A. you will prove to them they have a 'live' one, and the letters from them will multiply.
B. The invoice is speculative at best and they are famous for doing this
C. if what you say about events is true I would suggest you have nothing to fear. They have to prove their case, even if they get you to court which is highly unlikely.
D. They are looking for those that roll over easily.
E. Keep your powder dry and your cards close to your chest until you really need them, much later down the line if at all.

I know others will disagree, but....

do the following



1) DO NOT contact ECP until you have done the rest

1a) register on pepipoo.com

2) post this in the Private parking ticket section,do a copy of the 'invoice' for it is only that and leave no identifiying marks on it, eg name car etc

3) listen to the advice given by EDW, hcanderson,Schoolrunmum and those with postings in the 1000's

4) they will possibly advise you to
a) send what they call a soft reply and claim a POPLA code from ECP
b) when you get that you hit the with a 'NOT a genuine pre estimate of loss' defence.POPLA 99.9% of the time agrees and job is jobbed The bonus is while the PPC has to agree with POPLA IF it goes against you, you dont and can still refuse to pay. The chances of them doing court is slight and also ignore any blustering about 'debt collectors' and solicitors letters.

All this can be found on pepipoo.

OR you can pay the 100.00

personally, i would give these a run for their money, it costs them 27.00 to go to POPLA, so they are on a loser straight away. as only the unsure and the uninformed pay them the 100.00. If everyone went the POPLA route it might get them to act in a more appropriate manner

Also be wary of what you write, NEVER say you were the driver, its always the driver did this, the driver never saw that etc as some of them read pepipoo and take notes!!!

3 weeks passed and then i got a letter saying they've dropped it. I assume because they took too apply adn reply to me with a POPLA ref.

Please do not pay this ridiculous fine. I have sucessfully avoided three of these 'private' fines. Its just a breach of contract and I am happy to help if you want.

I had this in a Morrisons car park last year, a friend had similar at Luton Airport.

After looking on the net for similar cases, we both ignored the original invoice (It's not a fine as someone else mentioned) The letters came, the amount went up....then down ! then stopped.

From memory two things stick on my mind but please check;

1) If they did decided to take legal action they can only try and claim the parking charge...i.e. a couple of quid.

2) In the history of ECP they have never taken anyone to court !

As an aside I regularly drive by a large house in a nice part of London near Regents Park, on the driveway are usually a couple of G Whizz cars all painted up with an ECP logo, and an old Silver Spirit with an ECP number plate, might even be ECP 1, or ECP 10 or similar.

Anyway, not sure who lives there.....but a useful place to forward your unwanted ECP post & letters.

I don't know where you get your information from but I believe you are quite wrong on both counts. Google the incidence of court cases involving ECP and you'll find quite a few. As to the amount of the allowable claim: they can try and claim whatever they estimate their loss to be.

There are good defences to avoid having to pay these punitive charges however misleading posts such as the above help no one.
