Covenants aside, how is the OP supposed to be competing with his ex-employer? At no point has he said or implied he would seek to sell equipment, so no competition there. He cannot offer warranty work on equipment supplied by his ex-employer, so no competition there. The only thing the covenant is protecting is whatever non-warranty work he fulfilled for customers as a corollory of the warranty work carried out; anything beyond 6 months is restraint of trade and even that's being generous to the ex-employer, who seem intent on soiling their own nest by accident or design.

Or, the employer folded, gave him everything he wanted and waived the covenants, vindicating everything the OP said about his harsh treatment. He also got an apology, his tools back and a hand job.

There will be no custard available though, anywhere (hand job aside).

You're entitled to your political views but personally I believe the speed plod law section should be about that and your politics put in other more appropriate sections. Its just a thought.

You're entitled to your views as to what is appropriate for each section of this forum, but I think you should keep those to yourself. It's just a thought. There are moderators to look after that sort of thing.

BTW, what I posted has absolutely nothing to do with politics, and everything to do with right and wrong, so is ideal for this forum.

Still, been a week or more since an update. Possible incorrect advise from the solicitor? Shirley it would be pretty clear cut of it were a case of unfair dismissal.

It's not surprising if the OP has decided he doesn't want to bother with this thread again, it's counter-productive to attack posters in the way he has been.

Well, there are two things to bear in mind.

1. There are very poor lawyers out there who don't know how things work
2. There are those who will advise a scrap even when it is highly unlikely to win, because they get paid either way

And that is on top of the "f**k it, worth a go" attempts that may take place i.e. complain in the hope the company will pay up before lodging a claim.

However, in this case I would foresee an ET judge saying exactly what some posters here have said - the OP appears to basically want to have the company pay for the time he is on Honeymoon etc then leave to start up his own business. I don't see it ending well for him in Tribunal.

I'd be surprised if he has even had a proper reply from the employers yet, they will likely drag it out as long as they can.

I'd be surprised if they haven't told him to shove it and sue them if he dares. And now he must weigh up whether to expend what could be significant costs only to lose at Tribunal (as I suspect his employer won't play ball with ACAS either, why would they waste time and money on this?).
