As someone who cycles a lot and often through queues of rush hour traffic, every other moron in their car is using their phone

Head bobbing down, phone between their legs or on their lap

Women and Facebook is a particular issue.


You wouldn't really spot it unless cycling or walking past so close. Apart from you do see many people not edging up in queues due to staring at their crotch

wow - people really need to chill out.

the court obviously didn't find it necessary to prosecute me for being on the phone, yet some people behind their keyboard think they know it all and it makes for reading your comments really boring.

thanks again to those who actually responded with advice on what to do with the situation i was in (hence the reason of making the thread)

With so many people being done for using their phone whilst driving the reason for dropping your case will be of great interest.

If you could post the details when you get them it could help a lot of people.

so this guy who seems to actually have been speaking on the phone, gets off, yet last year there was that guy they pursued to the ends of the earth to try and prove the offence applied to him in a car park.

Your the idiot caught, in you own admission using the device.
Perhaps you will now invest in hands free kit or better still just don't use the phone while your driving.
Or will you feel the same way if someone runs into you or knocks your kid over while using the phone and driving eh ?

Not hiding behind a keyboard I would tell you to your face.

I don't know about you, but I'd be pretty pissed off if someone ran into me or knocked my kid over whether they were using the phone or not.

this is all i can think of also. dint ask to many questions once was told it was dismissed - if i get any paper work or hear anything else ill let you know

You come onto a public forum and admit you were using a hand held device, well you have to expect some flack.
I have lost count of the times I see idiots like you trying to drive while holding and using the phone in full view.

Out of interest how do you know his phone hadn't slipped from a cradle and fallen to the floor. He picked it up and put it back and to cop saw him do it? Would you feel as irate if instead of his phone it was a banana?

I agree, people using phones on the road deserve little sympathy; the danger they pose is well documented. However, it's best not to judge until you know all the facts. As we don't know the facts, let's avoid judgement.

These are such easy targets that if the Government really cared it would put some resources into clamping down. I see 10's of drivers using phones every single journey.

The inverted commas to me make it sound like he had it in his hand. He was "using" it in the eyes of the law. But who knows. Until we do, let's be constructive.

I have a phone with no sim card in (locked to Tesco) which I use to hook up to free WiFi, and as a SatNav using the GPS and maps on an SD card.
Is it an offence to "use" the device if it is incapable of being used to communicate in the manner I have described?

The only time I ever need to touch it once I have set off is if the screen angle is picking up a reflection, but I have always wondered!

And I get done in a bus lane which wasn't signposted correctly
Everyone says pay the fine so I did
Could have said fk em and got away with it

On another note I got summonsed but got off by writing nice letter
