Probably - it sounds like it could still fall under the heading of a "hand-held mobile telephone or other hand-held interactive communication device" : http://www.legislation.gov.uk/ukpga/1988/52/sectio...

The law doesn't require it to be actively communicating at the time - hence all the queries about using it as Sat Nav, music player etc.

Without any knowledge of the situation, i.e time of day, location, other traffic on the road, what I actually did "use" my phone for etc (surely even you can figure out why I wouldn't want to write too much before any court hearings) but being so narrow minded you continue to make these stupid comment which only make you look more foolish.

Is your life really that unfulfilled you have to come on Internet forums and call people idiots?

your phone can still be used to call 999 (or 112) so, it's still a phone, even without a sim

I didn't realise that, but if I ever needed to dial 999 in an emergency, then I think such calls are exempt and are allowed, so that should not be a cause of concern?

However, another thought occurred to me - I think a phone can be tethered to another via it's WiFi?
I bought the phone cheap on ebay specifically as a media device and WiFi portal as my phone does not have WiFi or downloadable apps. Unlocking the phone was going to cost £20 - more than I paid for the phone, so I never bothered, and still use the old device as my phone.

If so then no offence.

This. £5 for one of those green sticky pads on a stalk. No offence, and use the device (DWDCA notwithstanding) as much as you like with no fear of any offence.

It seems that SVTRick has lost track of what the truth is. Just because use of a hand held phone has been made illegal on safety grounds, and because he has witnessed instances of unsafe hand held phone use, he seems to have forgotten that it is impossible to ascertain whether any particular instance is unsafe or not without considering the sort of factors you mention. I wonder if he's also of the opinion that because safety concerns have given us a 70mph speed limit on motorways, it is invariably unsafe to drive at 80 on a motorway, regardless of the conditions.

Unsafe instances of hand held phone use were already illegal before the ban. The ban changed two things: it made the safe instances illegal too, and it introduced an offence that was easier to prove. The first part is what SVTRick would do well to understand - using a hand held phone safely is not impossible, it is illegal (just like 80mph on a motorway).

Hmm I wasn't the one facing a charge in court.
And admitting using said device on a public forum.

Pity the crown offered no evidence, and forgetting you had a summons with a date
to attend - oh well shoite happens.

Ah but this is pistons heads so it must all be true
Sod you lot it that time of day, off to the pub for early evening beers and walk the dogs.
