Curious more than anything really.......

Last night driving home from work and come across a rather unusual line of traffic in an NSL......when I get to the front there's a cyclist using a mobile phone and consequently wobbling a lot as they're not in control making it hard for anything to get past.

Is this legal ?

There's no specific prohibition on riding a bike while using a mobile phone - the ban on them only applies to motor vehicles. ( Link)

However it is an offence to cycle without due care and attention or without reasonable consideration for other road users ( link) and if using the phone was causing him to wobble all over the road then I'd suggest that would probably apply. Not that it's likely in practice that he'd be prosecuted for it, and unlike careless driving there's no fixed penalty that he could be given.

I had a cyclist come down a dropped curb straight in front of me on Monday. His head was down and it looked like he was sending a text. He then proceeded up a busy road taking most of the lane as he wobbled from side to side still concentrating on his phone.

It doesn't seem to matter what form of transport, cycling, driving or walking some muppets would rather concentrate on their phone than their surroundings and seem to have no idea of the danger to themselves/others.

Ironically, in my case, I'm not sure he could give heard much of the conversation as there were lots of people hooting at him!
