Tobacco on a Facebook selling page?

Not me but on my local selling page one or two people put up a 'Tobacco for sale'
Is this legal as they have a lot for sale.

Probably fake if they have a lot of it.

Either that or they have a reliable supply chain to Adinkerke

It's perfectly legal to sell Tobacco. However, there are rules governing the sale of it.

Don't fook with HMRC.

If you read the link, you will also find it illegal to possess tobacco for consumption where no duty has been paid.

I'd take a wild guess that it's been imported, but without paying any of those pesky taxes. Therefore, yes, it's illegal to sell it.

My mum used to be quite a heavy smoker - we used to do the trip to Adenkerke a few times a year and she used to bring a fair bit back, all for her own consumption.
So the inevitable happened and she went into hospital to have a 3rd of one of her lungs removed.
Anyway, long story short, she is no longer a smoker, yet had several hundreds of pounds of her brand in the cupboard.
Thankfully she managed to find a local neighbour who smoked the same and she slowly sold them to her over a 4 month period and didn't make a single penny profit - so sold them at the price she paid.
But I was convinced I'd get a phone call from her one day saying she'd been arrested. HMRC take so a dim view at evasion of tax & duties.

Yes, she got away with it. Even if it was duty paid in the EU you're only allowed to gift it in the UK, not sell it.

Thanks for the replies, it seems to be the same couple of people selling and the fact they advertise a few different brands, I would guess they need to be carefull or a knock on the door by HMRC might be happening.

On a related note one of my ex-Bosses was a 40-a-day smoker. Whenever any of the team went on holiday she'd give them the cash and they would load up on fags at duty free for her. I assume that was also legal?

No: see the link I posted. It would only be legal if they bought them with their own money and gave them to her as a gift. Note also that the amount you can bring in differs depending on whether the country in which they were purchased is in the EU or elsewhere.

Of course someone would probably have to have grassed her up for HMRC to find out. Or else one of her team had dropped the ball on the quantity brought back and an Customs officer at the (air)port of entry became suspicious.

Eventually HMRC will show an interest in this. Go to any local for sale group - always drink and tabs for sale, and i doubt people selling vodka (adorned with glitter or not) are lisenced.
Doesn't bother me though, to be honest. Facebook is just the new dodgy geezer in the pub wearing an oversized jacket!

Its the time of year, people going on holidays and bringing back loads of fags.

They can make approx £20 on each box of 200, so 20 boxes pays for the holiday in some cases.

Call plod if you want - it is illegal.
