9 Points on license & now caught by speed camera, what ban?

I had this issue, 2 weeks away from 3 points coming off got caught worried about the potential totting up as I was on 9.

sent license of, came back with 3 points on, so you may get away with it.

You'll have to go to court - not sure if you're supposed to realise this and decline the fixed penalty offer or if they tell you.

Hmmm...I don't think it's supposed to work like that - you should have hit 12 points.

Coincidently I'm actually 4 weeks away from 3 points dropping off (if its 3 year stints) frown

I can't remember, I'll have a look when I get home. It did say (boldly IIRC) that I only had 28 days in which to accept the offer. I would assume a court hearing would then be set for me.

might be worth checking what you actually have right now. Went to add my missus to my insurance and she thought she had points. Turns out she didnt when we checked online.

tHANKS. I did that immediately I got the NIP, sadly I do have 9 points in force at this time.

I don't think you can accept this "conditional offer of a fixed penalty", as you break one of the conditions to be able to accept it.

Read the T&Cs of the notice, or you risk a hearing possibly in your absence.

anyway to drag out actually getting the points ? i thought totting up was on the basis of the date of conviction not date of offence ?

The system is flawed. They make the offer without checking eligibility (regarding endorsements). If the offender sends a cheque in, or makes payment online then they check - and return the cheque / refund the payment. An odd way of doing things.

Wrong. Offence date. See s. 29 RTOA 1988.

Its date of offence, the govt website where you can check your own endorsements shows the offence date and the expiry date which is exactly 3 years after the offence date.

Same end result, but agree it's a crappy system. Just figured there's no point letting the OP get all giddy.

Strangely there are no T&C's that mention anything relating to you becomming eligable for a ban should the 3 points bring you up to 12 points. I find that odd but have read all of the small print on the 2 sheets of paper that I received and that is indeed the case. confused

Read what agtlaw said, he's the guy you should be paying for advice on this, not pissing about on t'interweb. They'll just send your cheque back.

It doesn't say what will happen if I reject the offer or even if I simply allow the time to elapse - it just says you have 28 days to accept the offer during which time no action will taken against you.

Thats a fair point but I think I'll try the dual track approach by also hanging onto this post (out of sheer desperation) as well
