They won't until they ask to see evidence showing he was insured, which is one of the most likely questions when a foreign driver is nominated. If the keeper cannot supply that, they are very likely to be prosecuted

No I didn't, read the post, I said they should have powers to issue on the spot fixed penalty fines.

please point me to the relevant legislation which says they have.

But when you get a NIP, your only legal obligation to give driver details. Nothing else. You can only get prosecuted if the police can show that the driver was not insured.

A little update.

Police Scotland have come back and asked for proof of insurance for my Uncle, which has been passed onto them.

I await their reply.

Exactly as some on here said then. Expect a bit more of a grilling.

Would the CPS or Ploice request proof that he was in the country?
