What does the "at Seller's risk" actually mean here?

If they send the cheque and it goes missing in the post it's tough luck....?
I questioned that wording with them ages ago, they said it was standard legalese. I didn't think much of it at the time...

I did try and get them to agree to a different form of payment but they are so incompetent I gave up.

If this is who it seems then if you google 'c**s auction not paying' you will see they have form.

Seen worse wink

Suspect BV 's seen worse upheld by a court as 'obvious error'.

Still pissed I didn't spot it though.

It's easily done. Bet you wouldn't have missed it on a live document for a client though.

He wouldn't, but some will. I once had a signed ws served on me with "check with client if this is correct" in the middle of it.......

Had similar this week. Engrossment for me to sign with £xxx as the consideration.

Square brackets left in are pretty common too.

Then you get, "it's ok if it's signed, we will just substitute the pages". Err right. Mercury ring any bells?

Near only drafts to clients go out like that as a rule if showing an alternative clause.

Have yet to knowingly drop one on a live document but have had far too many draft leases returned by clients signed by both parties. Even a fully water marked one with DRAFT on every page and no rent or term details, let alone the small matter of tenants name. Oh and the covering letter pointed out these were missing and awaited for from them.

LayZ beware of false promises. I went to that auction as I'd been flirted with by said company to enter my car into another auction they were holding later in the year and I'm local so thought I'd pop along. Anyhow long story short wasn't really impressed by the sales prices achieved (I sat in your old car, very nice btw) and fees etc so said no but I know a chap who entered 2 Mercs in for the sale, I bumped into him the other day again owed all his money, they even wanted extra for works the buyer demanded be done! it took him going up to their offices with his son demanding payment, even then they gave him a cheque for just one car! He too was told the person he was dealing with was overseas but when he drove up to HQ in Richmond lo behold he was there,red faced and apologetic with a swimming pool fully of excuses! IMO get yourself up to Richmond ASAP, preferably with some 'friends' get your money and bank as soon as, this is not the behavior of a reputable company...watch this space, something is not quite right here

Ah. That lot. I've had some dealings there. My advice is skip the lawyers (as the auctioneers are well used to dealing with them and will know that it is route 1 to more time wasting).

Get down there, get in their faces, and don't leave without all your money.

I went to an auction conducted by this company once. The atmosphere of spivvery was palpable. Most of the audience matched the company well - permatanned blokes with mahoosive watches accompanied by women too young for them with big sunnies on their heads.

Hmm. Seems I guessed the wrong auction house. Can the OP confirm that he is not talking about Barons? who pretty much hold all their auctions at Sandown Park (a place famous for horse racing). Wouldn't want anyone else to get the wrong end of the stick.

Yes definitely not talking about Barons.

The company in question obviously do a high volume of sales, especially given the catalogue for their next auction at Blenheim Palace (which has number of super-high-end lots, e.g. Gullwing SL) so I am not that worried.

I don't think turning up there and shouting the odds is the way to go. Turning up at the next auction and making a nuisance of myself might have a better effect!

Can anyone recommend legal council if they don't comply with my demands (e.g. payment by Friday or else?).

Have you read this thread? Did you read the one on 10/10ths which Google will bring up? - these guys have form and lots of it for what you are experiencing and are well versed with the legal route.

Just because they have good cars consigned for Blenheim is irrelevant - they are not theirs and they are only in for the commission if they sell.

Visiting their office is probably your only chance of a speedy resolution but then if the £KK they owe doesn't matter then fair play....but it would sure as hell motivate me

Yes read the 10/10ths thread, but that must be one out of thousands of cars sold, plus it was eventually resolved.

Don't worry, I am plenty pissed off with them, just don't see how me turning up there is going to make a difference. I don't have a day to waste on that.

Do not go and be a nuisance at the auction. They will just throw you out. I saw this happen at the sale I attended.

One letter from Wilmots, a law firm specialising in classic car disputes, will probably get a result. The company has been potted by Wilmots before.

BTW, the thread does breach PH rules, as it is obvious which company is being discussed.
