June 5th I ring up and state I don't want to continue my policy, year end no auto renewal thanks.

Guy on phone says ok no probs we can cancel but the money may be taken automatically but not to worry it will be refunded ASAP keep a look out on your CC statement.

July 15th I get the statement, they've took the money but not refunded, I call them up and explain the issue they say let me speak to a manager blah blah blah.

Turns out they've never cancelled it, so they ask me to prove I've not driven the car since June 5th, I send them sorn doc and mot expiry info from dvla, they also listen to the call I made on the 5th of June and indeed agree it should have been cancelled.

Nothing happens. I ring today and they say they that proving sorn and having no mot does not prove that I haven't driven the car, then they say I won't get the fully amount back for the policy £250 as they've had to maintain insurance on my vehicle for the past seven weeks.

I say bks to that its your mistake I want the full amount, they said we need proof you've not driven the car otherwise no refund.

Clearly you hit back with a requirement of proof from them that you have driven the car. And a note pointing out this is the final correspondence before you 'get legal'

If they took the money there is presumably either a DD in place or they stored and used your card details. Either way you should be protected by your bank.

It does not matter what happened after it was assumed the insurance was cancelled, or not. It's the problem of the OP. There could be tons of reasons for him to cancel.
Would have they paid out if anything happened in the period they are arguing about? Doubt it.

It's also something that has no relevance and does not need answering. He told them to cancel, the error is entirely theirs. Whether he drove it or not is of no consequence.

Agreed, If something didn't happen, how does he provide evidence that it didn't happen.

No. Credit card payments don't work in quite the same way as DDs. I will put money on the OP having (perhaps unwittingly) given the insurer a Continuous Payment Authority and has failed to cancel it with the Credit Card issuer (not his bank). Also the insurer is asking the OP to prove a negative which they know full well is virtually impossible unless the vehicle was sold the day before the expiry date of the existing policy. They are jerking his chain. I don't see how they could hope to get this to stand up if it were to taken the FOS. They are counting on him not having the patience (due to the time delay involved) to see it through.

It's hardly any wonder that people think that insurers are just greedy money-grabbing censored when this sort of thing goes on.
